Thaksin and 24 reds to face indictment for terrorism

The Department of Special Investigation on Thursday submitted for prosecution review on its investigative reports, recommending terrorism indictments and trail for 25 suspects, including ex-premier Thaksin Shinawatra.

DSI director general Tharit Pengdit handed over the reports, comprising 60 files, for the first batch of 26 terrorist suspects relating to the red-shirt rally from March 14 to May 19.

The case on one of the 26 suspects was dropped because Maj General Khattiya "Seh Daeng" Sawasiphol was killed in a gun attack in May.

Tharit said the DSI had recommended indicting the suspects for terrorism charges as prescribed in Articles 135/1, 135/2 and 135/3, in conjunction with Articles 83, 84, 85 and 86 of the Criminal Code.

As for the case involving Thaksin, the DSI requested for an additional indictment as per Article 127 of the Criminal Code, he said.

Article 127 prescribes for offence deemed harmful to the country and committed from foreign soil.

The Office of the Attorney General has assigned Thanapit Mulpruek, the director general of criminal litigation, to take charge of vetting the DSI reports.

As the mandate to remand the suspects under the emergency power and the Criminal Procedural Code will expire in 12 days, Thanapit said he was uncertain if the prosecution review could complete before the deadline.

"The custody for remand is not a serious issue because the public prosecutors can summon the suspects and initiate trial within the statutory limitations," he said.

Should the prosecution review fail the meet the deadline, the suspects must be freed from remand, pending trial.

In addition to Thaksin, the DSI'list of suspects included Veera Musigapong, Jatuporn Promphan, Natthawut Saikua, weng Tojirakarn, Waipot Arpornrat, Arisman Pongruangrong and Adisorn Piengket.

The others are Suporn Attawong, Kokaew Pikulthong, Kwanchai Praipana, Yoswarit Chuklom aka Jeng Dokchik, Nisit Sinthuprai, Karun Hosakul, Payap Panket, Wiphuthalaeng Pattanaphuthai, Phumkitti Sukchindathong, Suksek Pholteu, Charan Loypool, Amnat Intachote, Chayut Laicharoen, Sombat Makthong, Surachai Thewarat, Rachata Wongyod and Yongyuth Tuammee.

Bangkok - Thai police on Thursday recommended that terrorism charges be filed against former prime minister Thaksin Shinawatra and 24 others for their alleged roles in the deadly clashes between anti-government protestors and security forces in April and May.

Department of Special Investigation Director-General Tharit Pengdit handed 60 reports on the suspects over to the Attorney-General's Office.

The reports describe the suspects' alleged activities during the anti-government rallies and violence from March 14 to May 19, which caused the deaths of 91 people and injured over 1,800.

The list of suspects includes most of the top leaders of the so-called red-shirt movement that organized the demonstrations.

In addition to Thaksin, who is living abroad to avoid a two-year jail sentence for corruption, five more of the suspects remain at large and are believed to have fled abroad.

Major-General Khattiya Sawasdipol, alias Seh Daeng, who was on the original list of 26 suspects, was shot dead at a demonstration site on May 15.

Although Thaksin was abroad during the demonstrations, he spoke to the crowds in live and recorded broadcasts, urging them to carry on with efforts to bring down the government of Prime Minister Abhisit Vejjajiva.

Deputy Attorney-General Waiwut Lortrakul said prosecutors would try to finish consideration of evidence and prepare indictments for submission to the Criminal Court by August 10.

If the prosecutors were unable to submit indictments to the Criminal Court by that time, the suspects currently being held would be released, he said.

Speaking of the Dynamic Duo, and in a separate case than the terrorism indictment, Thaksin had another arrest warrant issued against him for defrauding the Thai nation today. I believe it's the eleventh case now that is anxiously awaiting his return to his homeland:

BANGKOK, July 29 - Thailand's Supreme Court Criminal Division for Holders of Political Positions on Thursday issued an arrest warrant for fugitive ousted prime minister Thaksin Shinawatra for filing a false assets statement, but temporarily suspended the case until he is arrested.

The court decision was taken as neither Mr Thaksin or his representative appeared to hear the charges, which was deemed as possible flight.

As the court still does not know when the accused will report to court, the panel of nine judges agreed to temporarily suspend the trial until the fugitive premier is apprehended.

The court said the case will be considered again once Mr Thaksin is brought to trial.

The National Anti-Corruption Commission (NACC) earlier filed its case with the court after the Supreme Court Criminal Division for Holders of Political Positions on February 26 ruled that Mr Thaksin and his former wife had concealed their declarable assets and that the ex-premier had abused his position as prime minister to enrich their personal businesses.

The court ruled to seize assets valued at Bt46 billion (US$1.4 billion) from the former prime minister and his family.

The NACC said the court ruling means Mr Thaksin falsified his financial statement by hiding the assets in the names of his children and other family members. The panel of nine judges therefore agreed to proceed with the case as filed by the anti-graft agency.

I am not so sure about the black. RED In this term the Democrats have achieved greatly. Spend our time chasing Thaksin, Thaksin and Thaksin cannot nail the fugitive so we will try to get him out start on the red shirts. Thai kill Thai. We are not amarat but we will have a dinner for reconciliation and the commoners that serve us, can crawl on their hands and knees to serve us. They started on Thaksin instead of never mentioning him and now they have made a rod for there own back. No matter how people think he does not have a huge following, he does. And to throw him in the limelight instead of going about there jobs, the democrats and Thailand will never win. I hope the law starts chasing the leaders of all parties for anything criminal, they have done, and checking bank accounts of all party members and government officials. And we all know Thaksin has done some dastardly deeds, but there are a few there that make him look like an angel. And as we all know the serious sentencing will come later than sooner unless you.

Look at it this way, if there was a hostage crisis and one guy was on the brink of killing a few hostages and a good crack shot of a policeman took him down before he killed anyone would that constitute as murder?

I was in Silom when this nutcase was shot, my wife was not far away and I needed to collect her and see to some of my staff before doing so. There was something going down hours before he was shot and I could feel it, it was not nice. I would not say it was murder, I reckon whoever shot him saved lives. Maybe even many lives.

Quite correct he does not have a huge following. Unfortunately his following is one full of anti peace lovers. They want nothing more than to cause trouble and with his billions of dollars they can afford it.

Imagine what life would be like if he had a huge following. Remember Hitler he had a huge following.
