I am looking for advice or assistance for the following case:

My son and two of his friends were diving on the island of Samui in March.

When returning they had their boarding passes made on the international website of the company ETIHAD (e-check in).

On landing at BKK, from the flight Samui-BKK (Bangkok Air), at the domestic terminal, they saw that we can go directly to the international terminal. But there was NO police checkpoint.

They went with no problem at the gate ETIHAD.

The PROBLEM is that they had no exit stamp from the immigration police, reported that the employees of the company, but it was too late, they had to board the aircraft ready to depart.

Now their big concern is to be denied a new entry in Thailand. The Thai Embassy in Bern (Switzerland) said he could do nothing and a letter to the Immigration Office in Bangkok remained unanswered.

My question: will they have any problem when they return to BKK, with a writing English paper explaining the matter, and with their boarding departure card from previous flights, and also 2 letters from Bangkok Air and ETIHAD attesting they made the trip?

As I recall, there was a long thread here maybe 4 years ago started by someone who had enormous problems because he returned to Thailand and lacked a proper exit stamp from a previous visit. You may find it by a search, or perhaps someone else will remember the details.

Could he not simply get a replacement passport?

Their best option would be to apply for a non O visa at the Thai consulate of their country. The no exit stamp should be picked up and then they can deal with the problem before they arrive in Thailand.

If this is true is does seem to be a major breach in Airport security.

Were they not supposed to clear Immigration at Samui? Or am I missing something?

An embassy is not immigration. Only immigration can resolve this matter.

As pointed out there has been special procedures for some internal flights where you process as an international pax at point of origin and can then transfer directly at Bangkok but it appears these people did not do that and because they held the boarding pass (indicating to security that they did) they were allowed to proceed to transit for the International flight. Bad security all around and not many officials are going to want to admit to what happened I suspect. But i suspect it may be noted on return as computer (and they have computers now) will show the person as overstay inside Thailand when that passport is read.

I suspect a new passport would be much less likely to get a red flag. But do have all the paperwork and old passport available just in case.

An embassy is not immigration. Only immigration can resolve this matter.

Surely the Thai Embassy in there country would help them if it is indeed a problem.

If not maybe they should email Thai immigration then. :blink:

I'd get a new passport and then play stupid when you return. Say you were stamped out and don't understand why 'their' computers don't show you leaving.

Keep the boarding pass stub from the last flight, bring that with you and casually show it to them when/if they ask you how you departed last time. That will be proof enough that you left on a registered flight and didn't slip out on an illegal border crossing, or some such.

If they push, suggest that perhaps the immgration officer didn't process you properly through the computer(which you have no control over) and make out your were allowed to board as normal. "I didn't see anything guv..."

I just left the US of A and didn't get an exit stamp at the airport either.

You never get an exit stamp from the USA. You don't even go through immigration. But Thailand requires processing through immigration for everyone prior to departure.
