My Thai mrs is self employed and is owed over 40k for the last several months by a falang businessman. It has got to the point where she either has to write it off or take legal action, I don't think she should let him off the hook as he spends wads everymonth in high class entertainment venues, so is not on the breadline, he also owes much larger sums to others but continues the high life.

What options are there to recover the debt? obviously as it's not a great sum (to her it is) it's not worth spending thousands on legal help, is there some sort of small claims inexpensive route? Should she start out with just a letter from a lawyer? maybe that would wake him up to his responsibilities. She has all the documentation with his signatures. This guy comes from a very rich family so he could easily get the money from home to pay off his debts.

She could sell the debt to professional debt collectors but that could be dangerous if they got too heavy and it was construed your wife paid to rough up the debtor.

Has he written a cheque to cover the debt and it bounced? if so I know you can go to that bank and put the cheque "On collection Demand"

Step 1....Get a lawyer to write a letter to the company saying if invoice is not resolved you will be taking legal action to recover monies

Step 2 - if step 1 doesnt get a response get your Mrs to lodge a complaint with the police, police will summon him to the local copshop for a face to face meeting maybe with your Mrs present....if he doesnt show....police can put an arrest warrant on him

Yes, this is the way to do it.... and if he has bounced a check on you, he will not be leaving that cop-shop... and its great if he tries to leave the country and gets arrested at the airport... all small business peoples hate this type of person... and there are many..!! Good luck... you should name and shame him...
