Assuming the mother agrees to give me full custody, would there still be a court required? I was hoping should it ever come to this situation, with a mutual agreement, we just both need to sign and I could get full custody. I don't intend to go for full custody against her will.

It depends.

If married you can divorce at the amphur and she can give you sole custody if in total agreement without any problem.

If not married, the mother has sole custody unless you go to court to legitimize the child and get shard custody. In case you want to get sole custody the mother has to agree and you probably will have to go to court for the change.

If you don't legitimize the child you can get actual custody over the child in the sense that you will be the care taker of the child, but you won't be the legal father.

Sorry for digging up an old thread but I too would love to know real life examples of court enforced Child Support ie how much people are paying ..

Can't find anywehere on the www.

I've disussed with a Thai and a also a Farang solicitor and they both say court decides but couldn't say how much !

I would like sole custody of my kids with estranged Thai girlfriend but that won't happen.

I'm happy to pay for Very good education, healthcare etc but I just know any THB I send her goes on her wardrobe and partying ...

If I understand your question right, it comes to the point of what I see is needed to improve the relationship. Well, a completely different topic.

Keep her emotional outbreaks better under control, stop complaining and comparing and make better use of time (English and intellectual skills)

But that's probably something between her and I and I don't see how a discussion here in this forum could help.

Child support is genrally in the amount between 3,000 and 6,000 baht a month per child. It depends on the age of the child.

next to that one shares the cost for education and healthcare.

You could pay directly to the school.

Had been thinking that re school and I do that anyways and pay 100% not shared !

RE the 3000 to 6000thb thanks for that...

Can you tell me how you know these figures, are they from the board, other members, people you know, solicitors you know ?

I know the stated amount is 5000thb per month, I don't actually see how a child could live on that but I suppose given the previous minimum adult wages ...they have to !

The courts usually award 100bht per day.

The guy often defaults, and they collect ZERO money and the woman gets to pay all the court costs.

(Thai courts have no way to collect from someone who isn't working in Thai taxed employment)

Child Maintenance in Thailand is a nice thought, but in reality a rare thing, and easy for foreigners to avoid if they don't want to pay. The chances of a Thai woman actually having the money to take the guy to court are very low.

Of course, it is a minimum and who can afford it should do better for the children. You can also pay cash and besides that give extra in the form of goods like clothing, toys, books etc.
