Help please, My wife has been living with me in the UK since feb 2009. her visa expires May this year. She has passed the Life in UK test.

On the Gov site it says she can apply after 2 years, I need clarification that becuase she has been livving here for 14 months she can now apply and not have to wait untll 28 days before her visa expires. the Gov sight not very clear on this. thanks for any help you guys in the Know.

She needs to have been in the UK for 2 years to get ILR. You need to provide evidence of the two of you living together in the UK for 2 years, which you can't if you have only been together here for just over 1.

She has been here for 25 months, what I cannot understand is whether she can apply now or have to wait untill 28 days before her visa expires which is may .

Sorry, misread your first post as Feb 2010. If she has been here over 24 months on settlement visas, then yes, she can apply for ILR at any point as long as you have all the necessary stuff they require.

I'm in the same situation, the wife's visa expires in may also.

decided to go down the express route and fork out £1250. joke to say the least.

appointment is next Monday so will let you know of our experience.
