hi

can anyone help with a few questions

thai wife and i want to divorce :(

anyway shit happens

she is here in the uk on a spouse visa arrived in uk 05/08/09

we both want to divorce not realy a lot of bad feeling things just didnt work out

she is going back home to thailand within the next 4 weeks

can anyone tell me the procedure

Sorry to hear things have not worked out.

If you married in Thailand then you can divorce at the ampur where you married; but you both need to attend.

You can divorce in the UK, but only through the courts.

Do not divorce at the Thai embassy in London! Such a divorce would be recognised in Thai law, but not UK law, so according to UK law you would still be married. The only way you can legally divorce in the UK is through the court, even if you married outside the UK.

With regards to her visa, you could contact the UKBA to tell them the marriage is over, but as it expires soon and she's leaving anyway I wouldn't bother.

Odd though it seems, you will probably get better advice if this is moved to visas.

Although I have no intention of divorcing.............yet anyway...........I was married in BKK and am UK Citezen.....where would I need to divorce here??? BKK or where we are registered Tambien?...also would that suffice for UK law, or as your post suggests I must get divorced there also???

I understand that a 'quickie' ampur divorce has to be done at the ampur where you registered the marriage. You can divorce through the Thai courts anywhere, but this takes longer.

Like the marriage, the divorce will also be legal in the UK if it is legal in the country where it took place.

You don't have to divorce at the same Amphur that married you 7by7, you can divorce at any Amphur, but as you say you must both attend and be in agreement, and have both original marriage certificates, or (if one or both have been lost) a certified copy of the marriage registration which can only be obtained from the Amphur where you got married.

I got married in Bangkok but we divorced at the Amphur in Bua Yai, Korat. My wife needed to update her ID card there first and they said they could do the divorce as well.

If you married in the UK I also understand that you must go through the Thai courts to divorce in Thailand.

Yes you do. And, as I said before you need both original marriage certificates, or (if one or both have been lost), certified copies of the marriage registration can be obtained from the Amphur before you get divorced if it's the same one that you got married at (20 baht per copy when I got them). You'll also need your passport (plus a copy) and your wife will also need her ID card and a copy of her tabien baan.

When I got divorced we went to the Amphur where we got married because we also needed copies of our marriage registration, but my ex wife's ID card also had to show that she was married (although that may have changed recently, I'm not sure) and, as she'd already changed it back to single, we had to go to her Amphur in Korat to change her ID card back to married first, then get divorced there. We then left her there changing her ID card back to single again. Bureaucracy at it's finest. :rolleyes:
