Hi I intend to fly to BK to meet my GF sometime in june this year with all the relevant paper work to go to embassy together. She was already successful with a tourist visa last December which she stayed with me for 10 weeks we have also been together now for 25 months in that time I have been to see her 5 times last time in September to sort out TV together.. Well my questions are

I intend to visit her for 1 month.. Hopefully her visa will be granted about the time I fly back to Uk .. Is that a bit risky? will she be able to come back with me and can I get her a one way ticket as after 6 months we will be married an applying for the settlement of 2 years visa can she take the TB test in UK or does she have to have it in Thailand bbefore she leaves ... Also do I have to pay £ 600 twice once for fiancee visa then again 6 months later or is this a one time fee are there any other charges I may incur apart from the register office marriage... Can we get married at a local office where I live or dors it have to be a special uk border one... Also once we are married and living together properly wil my tax credits and free prescriptions stop which subserdise my income.. I'm aware she will not be entitled to public funding but will I be ok to receive them any advise on these few questions will be gratefully received thanks

  1. Its currently taking up to 12 weeks to process settlement visas
  2. You can book a one way ticket
  3. TB Test must be taken in Bangkok
  4. And she must also take an English test in Bangkok
  5. The fee is currently 42500 Visa Fee + X-Ray fees 2600+ English Exam 7000
  6. Once married you must apply for FLR further leave to remain
  7. You need to marry within 6 months & also do not leave it too late as you must give notice to the registrar.

Your schedule is far too tight in my professional opinion we are preparing a fiancée visa now for the applicant to travel in July for a client.

Thanks for speedy reply.. Are there reputable Exam places to take the test are you able to reccomend A bonafide one? I thought Thais could take the test in uk within the 2 year settlement period as may need some night school pre training first but I am confident her speaking English is good

There are now two tests required by those settling in the UK as a spouse, fiance or partner.

The one you refer to is the Knowledge of language and life in the UK (KOL) requirement which must be satisfied in the UK before applying for Indefinite Leave to Remain.

The other test is the New English language requirement for visa applicants coming to join partners in the UK and must be taken in Thailand before she applies for her initial visa. Details of where to take this test in Thailand can be found here.

In addition to the costs outlined by TVE above, once the marriage has taken place in the UK the cost of her application for FLR will be £550 by post or £850 in person for a same day decision. Then, after two years, the cost of her ILR application will be £972 by post or £1350 in person.

Note that these are the current fees, and are subject to change.

Are you sure that you want to marry in the UK? If you marry in Thailand then she can apply for a visa as your spouse. The cost of this is the same as a fiance visa. However, it will be valid for 27 months and once she has been in the UK for 24 months she can apply for ILR. This eliminates the FLR application and saves that fee.

Also, if she enters as a fiance then she cannot work until she has received her FLR; if she enters as a spouse she can work immediately.

Whichever you choose, she would be prohibited from claiming most public funds, though you can claim any to which you may be entitled as long as you don't claim extra for her. However, tax credits have to be claimed jointly by spouses, so she can, indeed must, be included in this.

You can marry at any register office, provided you have both lived in the area for at least 7 days. However, as she will be subject to immigration control you must give notice at one of the designated offices and provide certain documents.
