Hey I see a lot of talk on here and I am wondering has ANYONE that was successful in obtaining a B2 Tourist visa for their TGF/TBF/TF whatever I dont care, did they use a Visa Agency; and if so WHO??? I talked to an immigration attorney that was an American in Bangkok and his office doesnt work with B2 Visas, but advised against the fly-by-night Visa places all over. Most seem to want to charge a lot of money, but cannot guarantee the process except for getting the appointment (maybe?) which is the obstacle I am against now for my TGF. We have done the application, paid the fees, and got several substantiating documents to include:

Her Passport

Passport Photos

Application Confirmation

MRV/ Visa Application Fee Receipt

Appointment PIN

Invitation Letter from me

Copies of her bank book

Proof of my employment overseas (hoping this shows less ties to the US)

Proof of my Tax Exempt Status for residing outside the USA

Roundtrip tickets from BKK to LAX

I guess I could also send her copies of my bank statements, her rental agreement for her apartment, and a copy of the deed to my condo in Thailand.

All I wanna do is take her to America for 2 weeks, let her meet my folks, take her to Vegas, and Disneyland... Any info would be great, this thing is killin me

I don't think you can do much else. You have shown her ties to you and that you have no intention of living in the US.

Not meaning to sidetrack the thread, but I am curious as to your "Proof of my Tax Exempt Status for residing outside the USA". What document would that be?

That is the Form 673 which is a IRS Document that states you are either a legal resident of another country (i.e.- Residency Visa) or physical presence exemption, which is what I use for living in Afghanistan. I have included the form below.

That doesn’t make you “tax exempt”, that makes you withholding exempt. That form is used so you don’t have federal tax withheld from your paycheck on the reasoning that the first $91,500 that you earn overseas is excluded from US tax. Any amount over that you will owe tax on and you should be making quarterly payments on the estimated amount. I certainly hope if you are working in Afghanistan you are making more then $91k.

Anyway, good luck on the visa. One thing that might help is some letter or other proof that your job in Afghanistan will be there when you return from your home leave and will go on for some time afterwards. This helps show there is no intent for you not to return to Afghanistan and to marry your GF allowing her to go for a change of status.

Yes, that is what I meant for my tax withholding, however to maintain my exempt status; I must remain out of the US for 330 days a year. I included my Letter of Authorization, which states I am on contract in Afghan until it renews in October. I can also send her my vacation request that I put in to my company that indicates my return to work as well as my flight itinierary showing my roundtrip tickets from Dubai to Bangkok and back.. Thanks for the input this junk is really giving me a headache and I really want this to go through. Again any insight is greatly appreciated.

I'm in the same boat as you. Waiting. She went for the interview last week and was told to come back in a week with a new DS-160 because she had not indicated that I had assisted her with the application. We thought that was referring to an agency.

Anyway, I hope she gets it. She has a stack of documents showing among other things that I have lived and worked here full time since 2007 and that she owns a house and car, and makes good money from a full time job (letter from employer included) and her own business. Neither she nor I have any desire to move to the US. Just want a 3 week holiday to see the relatives.

I would really be dumbstruck if she didn't get the visa, but it seems to be one of those things where you can never be sure - I guess the mood of the interviewer plays quite a large role.

For a B2 visa, they don't ask about your taxes. I would not pay anyone to do the application for you. If you have a computer, you can do it yourself. There are a few questions that you will have to do some research to answer. The web site allows you to save where you are at that point, then come back later and resume the application. You also have the opportunity to look over the application for mistakes before submitting it. If you don't have a computer and internet, buy one with the money you save by not having someone else do it for you.

My experience with the US Embassy is you can have a stack of documents such as :

  • Employment
  • Assets house+ land +car
  • Evidence of owning a business
  • Immigration history
  • The sponsor has more than adequate funds

And still they decline you a Tourist visa, so we just don't bother processing US Visas any more. My office pa applied & was successful one remark she did say is if you get the over weight processing officer you don't get the visa !

And she has been proving right on two occasions rolleyes.gif.

But it sounds promising as she has been called back, we never get the true picture of what are clients have said to the processing officers inside.

If that is the woman at window 5, she is famous for turning down applicants. I'm sure the embassy knows that she turns down more than anybody else. I've heard from some others, that if she turns your wife or girlfriend down, that they can demand to see a supervisor and know the reason for being turned down. The supervisor can and does over rule #5 sometimes. It's worth a shot if you get her. She has already been turned down, what does she have to lose?

She does not have alot of documentation, does own some land, that' about it. Maybe one point in her favor is that she is 44 years old, I'm 54. Any info would be appreciated. Hi Sunseek. All you can do is go in with what you have, be organized and honest. Don’t buy into stuffing the Gfs bank account so she can show money, or applying for a marriage visa. Just be honest. You need to request an interview soon if you want a late December visit.
