Jatuporn a Pheu Thai Party member, lawyer tells EC

A lawyer for Jatuporn Promphan submitted more evidence to a subcommittee of the Election Commission yesterday to support his claim Jatuporn is a member of the Pheu Thai Party.

The EC has so far declined to endorse Jatuporn as a party-list MP following a complaint that Jatuporn, who has been jailed, may have lost party membership, making him ineligible to contest the July 3 election.

Lawyer Winyat Chartmontree gave the subcommittee a copy of Pheu Thai party's regulations, indicating they included no provision that being in jail would cause a person to lose party membership.

He also presented a copy of a bail application submitted to the Criminal Court and an explanation why Jatuporn was not able to exercise his right to vote in the July 3 ballot.

The lawyer told the EC that Articles 40 and 45 of the MPs and Senators Election Act said the EC could no longer consider the qualifications of election candidates after polling day.

EC members yesterday rebutted allegation that the election was held crookedly.

"Any politician or MP candidate who has concrete evidence that EC officials have taken bribes, please inform the EC. We (EC members) do not want any doubts cast on case lobbying. [Complaints] should be clear, not a groundless allegation. At least a case should prove the allegation if it's true. The EC cannot function without people's trust. On the allegation regarding a golf game, none of the five EC members can play golf," EC member Sodsri Satayathum said.

On Pheu Thai and coalition parties discussing the first day of the House convening, House of Representatives secretary-general Pitoon Poomhiran said the schedule should be according to the law as the 30-day deadline after the election falls on August 1.

"The timeline depends on when the EC can endorse the number of MPs as required by the Constitution. I still believe the EC can finish its work within the deadline," Pitoon said.

Investigation into cases opposing MP victories would not affect the work of the House, he said.

Morally and Ethically unacceptable though whether or not it says so in the PT membership waffle. Hardly keeping with the spirit of being a role model for the younger generation. And you know what they say about a few rotten apples!

Your passion for Thaksin and PTP, the winners of the recent election, are admirable, but defending people (red leaders and black shirts) who called for the city to be burned, and then BURNED THE CITY, is misguided, to say the least.

they are not facts, they are simply allegations, if i was to call abhist a murderer based on his orders last year the post would be deleted and I would be suspended.

It seems you have no idea of the law, you are alleging someone is a terrorist, then he is an alleged terrorist, if/when he is convicted then he is a terrorist. if you are so sure you are correct then take it further, call his lawyer and call him a terrorist, see how far you get.

Som Tum, calling for something and doing it are two different things, I will defend my judgment until the trials are finished and convictions are in place, if the reds are indeed guilty of the acts I will condemn them

It seems you have no idea of the law, you are alleging someone is a terrorist, then he is an alleged terrorist, if/when he is convicted then he is a terrorist. if you are so sure you are correct then take it further, call his lawyer and call him a terrorist, see how far you get.

By your legal logic Jatupron should be doing around 25 years for serial violations of defamation.

Be carefull what you wish... you might do the same time...on serial defamation of Thaksin...

Hard to defame a person's character, when that person has no character.
