Hello,

My wife and I have 1 child already which was born in Thailand so it has Thai nationality and Belgian nationality. I'm Belgian and my wife is Thai. My daughter got Belgian nationality because the law in Belgian allows this, since I'm Belgian and she is my daughter she has the right to Belgian nationality.

Now for my question. We will be moving to Belgium soon but may return in 5 years when we saved some money. We also want to have another baby which will be born in Belgium. My question is does that child have right to Thai nationality because it has a Thai mom? I mean it would **** if one child has Thai nationality but the other doesn't.

Thai law is very clear - a child born to a Thai national is also a Thai national, regardless of birthplace.

So yes, your child born there will gain Thai nationality, though you will have to apply to the Thai embassy in Brussels for the childs birth certificate and first Thai passport.
