I have a bar in Pattaya, which does really bad in low season but very good in high season, my worry is my me and my wife will not survive this coming low season unless we save our earnings of course! But if it does go tits up, I will have to return to the UK unemployed though I could get a job fairly easy but not 100%. How easy is it to get my family back to the UK. She is 19 btw. I'm only 28! But my Family are very rich in the UK. Could this help if they sponsored her. I would love to sort this out before anything happens so she can go back with me with my child together is this possible? I've done a search and couldn't find a relevant topic. We've only been together a year. But this is playing on my mind so any answers will be appreciated

There's another thread around at the moment regarding a law you Brits have about not being able to bring a wife into the country if she is under 21. Apparently it has been ruled as un-humanitarian and/or unlawful. The law is still in effect and there are cases of appeals being lodged. Maybe worth reading this thread.

Current UK immigration regulations say that in spouse/partner settlement applications both the applicant (your wife) and the sponsor (you) must to be 21 or over. This has successfully been challenged in the Supreme Court and ruled illegal'; but i don't know if the government intend to appeal and when/if the regulations will revert back to the previous minimum age of 18.*

Hopefully someone with recent experience/knowledge (TVE? VP?) can advise further on this.

You may find Settlement; Spouses and Maintenance and accommodation (MAA) helpful. You will see from the latter that third party support is acceptable and staying with friends or family is also acceptable; subject to the accommodation available being suitable.

If you do not want to settle in the UK, then you can apply for a family visit visa for her. You will need to show that you do intend to just visit and are not trying to by pass the settlement rules. See UK visit visa basics.

Assuming that you are British and were born in the UK then your child is British too, so you should get a British passport for her. She is also Thai, so you should also get a Thai passport for her. She then can enter and leave both the UK and Thailand without any visas or restrictions.
