Hi,

next Wednesday, my wife and I are scheduled to hand in her application for a settlement visa. I have just arrived in Thailand with the application and supporting documents completed.

We are saying in the visa that we are going to live at my parent's house (where I still live now). Included in the supporting documents is a signed letter giving there endorsement for this.

My wife has just told me that one of her friends who has an older English husband (presumably he has some experience of visa's) has told her that if we are going to live at my parents house, then they have to be her guarantor, and not me.

Does anyone know if this is the case? Last year I earned over £35k, so it seems a bit nonsensical that I can't just be the only guarantor listed.

Any help greatly appreciated,

It is difficult to give an answer if you do not say which country your wife is applying to!

You mention your income in Sterling, which indicates the UK; but UK settlement applicants do not have guarantors!

They do have sponsors, though; their British or UK resident spouse/partner.

If you are asking about the UK, the following applies; if not the UK then it doesn't.

As her husband, you are the sponsor and as you will be providing the finances for her maintenance in the UK then it is your financial evidence that should be included in the application.

Accommodation can be provided by a third party, such as the sponsor's parents. In which case the person providing the accommodation should provide evidence that they can do so, proof of ownership if they own or a landlords letter granting you and your wife permission to live there if they rent. They should also provide evidence that the accommodation is suitable, with at least one room for the exclusive use of you and your wife.

Third party support is allowed and you will need a letter from your parents confirming this.

Maintenance may be provided by either:

  • The applicant with their own funds or with funds available to them; or
  • The sponsor; or
  • A combination of applicant and sponsor funds; or
  • Third party support (see below).
    A couple or other applicant who is / are unable to produce sufficient evidence to meet the maintenance requirement may provide an undertaking from members of their families that those members will support the couple / applicant until they are able to support themselves from their own resources.
    Third party support is not precluded from consideration under the maintenance requirements relating to spouses, civil partners, fiancé(e)s, proposed civil partners, unmarried partners, same-sex partners, children, parents, grandparents and other dependent relatives of sponsors who are settled in the UK.
    The Entry Clearance Officer will need to verify and assess an offer of third party support in order to determine whether an applicant satisfies the requirement that he / she can be adequately maintained in the UK without recourse to public funds. The ECO may request evidence (for example, original bank statements over at least three months) of the third party's assets.

The OP says while he and his wife will be living with his parents, he has sufficient earnings to meet the financial requirements, so third party support is not required.

Even if they did require financial support from a third party, the OP would still be his wife's sponsor; SET3.2 What is the definition of a sponsor?

The sponsor is the person to whom the applicant is married.

All this assumes the OP is asking about the UK; he still hasn't said.
