I have a friend who's Thai wife has a 12 months mutiple entry tourist visa to Oz . She is here at the moment and will be going back to thailand next month when she will apply for a spouse visa .

My Q is can she apply for spouse visa in Thailand then return to Oz on here tourist visa ??

Why don't you take easier path and apply for prospective partner visa or temporary partner visa? You will need to get a letter from a celebrant for 1st one and fill out myriad of forms for latter.

He cant apply for a prospective spouse visa if he is already married.......the temporary spouse visa is the first part of the entire process......eg, you marry, apply for a spouse visa, get the temporary spouse visa, after 2 years get the PR....

Yes, but she will need to be in Thailand for the grant of the spouse visa

If she is in Australia on a tourist visa and is then informed that the Spouse visa has been approved why can't she then just fly back to Bangkok to pick it up from the embassy?

Can you see any issues with this?

Not sure on that one Mav, When my wife did hers they actually rang her to tell her to come and pick it up, she only found out it was approved when she picked it up.....this is also how it happened with other friends as well.

Does't the medical have to be done in Bangkok? and it has to be done after the application, can't be before , How soon after the application is put in can you do the medical?

That is ok to do. The visa won't be granted until she is out of Australia.

She SHOULD get a phone call from DIAC saying they're ready to grant and ask when she is

coming back to Thailand. You should then go back ASAP and let them know your flight details.
