JSCM2012 Posted March 19, 2012 Share Posted March 19, 2012 Hi We're in the process of completing an ILR visa application, believe we've got most things covered. However, we will be relying on my partners income to meet financial criteria but with only 3 weeks left her employer has asked that she provide proof that she is still eligible to work while waiting for the immigration decision. Will there be any way that we could provide this evidence to the employer? Is it possible to check online or similar? I've looked for online payment / application but this is unavailable. Just make sure your wife produces at least 5 documents spanning a 2 year period or more at a registered uk address !!!! Good Luck. If so you may try giving them the letter of acknowledgment for the ILR application (to attach to the copy of the passport) and make it clear that there is an 18-20 week processing time at the moment but print out the UKBA page that shows her legal status remains the same as it was before until the application is processed! See: http://www.ukba.home...tionformset(m)/ Your employer needs to show that they have taken reasonable steps to ensure everyone employed is legally allowed to work! It is very unlikely that any prosecution would happen in this situation as it is so common! There is a helpline for employers: 0300 1234699 A quick call with an explanation should sort things out for them. It seems that it is now a requirement for an employer to check paperwork for all those employed with date limited visas every twelve months so it is not surprising they are making this request. If you can apply in person I would suggest the extra few hundreds of pounds is now worth it to save a very long wait and a lot of hassle!
