Dear members

I worked for six years( 2006 to 2012) in Thailand Industry and contributed equal share of PF amount along with employer in American International Assurance Company Thailand. my contract with employer ended.and I have returned back to my home country.I have applied refund of my PF amount as per statement of AIA with me.

Now AIA refunded only my contribution portion i.e 50%

And the employers' portion is not paid to me

What is contributory P F ruling position in case of employee contract is ended with employer?

Am I not eligible for employers' portion?

Since I am foreigner my employer not responding properly.

How can I get my PF refund 100% back to me?

Whom should I approach?

Please advise.....

Usually there is a minimum number of years (for my company it's 5yrs, but may be longer for other provident fund plans) that you need to work with your employer to receive the part that the employer put in. Please check your fund form to confirm

Yes I too read this info some where stating 100% for 5yers,80% 4 years and 60% for 3 yeras service completed. Today I have checked with AIA people and they confirmed that employer took away his portion! What to do now? Shall I make complaint to any statutory authorities for violation of legitimate rules to avoid refund of PF to employee? To whom should I complain? Please advise.

First try your employer. Then complain with AIA and if that doesn't work, complain to the insurence regulator.

Alternatively file a complaint with the labour office, they deal with labour disputes.

Today I have reminded all the concerned to that effect.

My specific point is whether an employee is eligible for refund of employer's portion of PF if he complete 5 years service?

Since I am foreigner and rules are in Thai language they are willfully/deliberately avoiding my legitimate benefits

Please quote the ruling position to ask them strongly and refer to authority concerned for arbitration.
