Hi there.

My wife is currently on a 2 year UK spouse visa.

Since being here she has had a conviction which is currently unspent. She can't apply for ILR due to the conviction, so we are going to apply for FLR.

Last year she went to enrol on an English course, but after an assessment the college tutor told her she is already at entry level 3 and was advised to take the life in the UK test.

Can she apply for FLR with a life in the UK pass? Everywhere I look says you need to take an English course, but surely if you are already at entry level 3, then the life in the UK pass is sufficient enough in demonstrating knowledge of language and life in the UK?

Please help I'm confused.com

The boarder Agency says that , She will have to take the life in the UK test . or an ESOL course. that's the criteria, as for her conviction you may have problems when applying for FLR.

Neither an LitUK test pass nor an ESOL with citizenship course is required for FLR.

However, she will need to show that she has obtained level A1 of the CEFR in English speaking and listening, unless exempt. See English language requirement. If she did this to obtain her initial visa and the certificate is less rthan (I think) 2 years old then she can use that.

I am not sure how her conviction would effect her application. A lot depends on what it was for and whether she was given a custodial sentence. See Suitability.

If the application goes in before Oct 2013 she will need the LitUK pass. Beyond that she will have to demonstrate her English skills further to B1 or above but if she is ESOL level 3 this should not be a problem for her (in addition to LitUK).
