First a bit of background info

I had a Marriage extension for about 7 years

I am Now Divorced

my son who is Half Thai and English lives with me , he is 15yrs old

I have Non-Imm O Visa which runs out on 19th Sept

I have 400k in Thai Bank 3 months on 18 August

I live in Pattaya, 49 yrs old

Can I apply for a 1 Year extension based on dependent?

What documents should I take ?

Does my son need to go with me to immigration?

How long before visa runs out should I apply?

Does the application still take 1-2 months?

If you have custody an extension of stay should be available for that (not dependent) and no time in account requirement but he will have to be present and should be done during last 30 days of a non immigrant entry and will likely take 30 plus days for final stamp. Another option is 60 day extension without financials on any type of entry. Section 2.18 (5) of police order 777/2551 and proof as listed in 305/2551 below:

1. Application form

2. Copy of applicant’s passport

3. Copy of documents proving relationship, such as a marriage certificate, a birth certificate,

registration of child legitimization, household registration certificate, child adoption registration

certificate, or other evidence from the government or relevant agency

4. Copy of evidence proving the Thai nationality of the spouse, parents, children, or adopted

children, such as a national ID card, copy of household registration certificate, or other evidence

issued by the government or relevant agency

5. Only for Criteria (5) and (6), the applicant must attach a funds deposit certificate issued by a

bank in Thailand and a copy of a bankbook, or attach documents proving that the parents or alien

husband earns an average monthly income of no less than Baht 40,000 throughout the year, such as

any particular individual income tax return together with payment receipt, evidence of receiving

retirement pension, evidence of receiving interest from funds deposit, or evidence of having other

funds issued by the relevant agency. An affidavit must also be submitted confirming the alien’s

marital or parental status with a Thai national.

Hi,if u don't have custody u will need a lawyer and go to family court and get a document what says u r the father,only birth certificate won't be enough.I did same about 9 yrs ago cost me about 12000bt and took about 9 months from start till end

As he was marreid to the mother, he is the legal father regardless of birthcertificate. But immigration sometimes want to see a custody order anyway. Most times that would take 2 or 3 months, depending on the court in question.

But.

I'm on a 60 day extension of a non-immigrant visa for as the dependant of a Thai child. I have the 400k in the bank and am sole custodian of the child (legal docs etc)

Will immigration grant a year extension - an extension of an extension as it were.

Or, will I have to obtain a new visa at a consulate abroad and then apply for a year extension as I am now rearing to do.

As extension was made on a non immigrant visa entry would expect that you should be able to extend for the one year from that. One year extensions are routinely made on the previous extension. What is not allowed is an additional 60 day extension without a new entry (but does not have to be non immigrant entry).

My deosit of 400k has only been in account for two weeks. But I do have three Thai bank accounts with an aggregate of over 40k a month being deposited. Hoefully I can should them the books and they will issue the extension. If not its off to Laos.

So if I can demonstrate that I have other 40k a month paid into a Thai bank for a year and a recent deosit of 400k timmigration will probably advise me to go outiside the country obtain a new visa and then extend after two months?

Sorry for dependent the money should not have to be in account for any set period of time. Reading too many posts about marriage without enough coffee today. You should be fine with the money. The 400k should be fine by itself.

Is a bank book (my name obviously) sufficent evidence of funds or do immgration need to see a statement / letter?

They will require a bank letter of account balance. Cost about 100-300 baht depending on bank. As well as bank book and copies.

I went last week to immigration in Bangkok. There is a branch of my bank, Kasikorn, and other banks in the government building. Offical asked me to go and produce a new letter during the interview - to check the money was still in account. Other documents includued the legal docs showing custody, tabien bans, rental contract for my house, amphur divorce certificate, and a letter from my son's school (not needed.)

I went alone and the interview was held in Thai.

I was given a one month stamp while the application for one year extension is under consideration. I was missing a docs (the rental contract) which I gave to the officer today.

I have recently returned from my visit to Jomtien immigration

All went well and they have now told me to return after 2 months (i applied 1 month before visa run out)

I took my son along with me

Documents i needed and 2 copies of everything

2 application forms

Passport

2 passport sized pictures

Rental contract house

Bank book with letter with 400k showing for 3 months

Custody papers

Sons house registration

Sons id card

Sons birth certificate

3 photos of my son and I together in the house and on the front of house mounted on A4 paper

Map of our house and where we live

Visa fee 1900 baht

Is that right that I did not need to have the money in the bank for 3 months prior to applying?

When applying for an extension based on having a Thai child there is no need to season the money in the bank.

Wonder , if this extension is still possible lets say if you are an older foreigner with a Thai kid who is an adult ?

I know that there in the past was a possibility of the child taking care of his/her parent , as in Thai culture is a custom , think its

interesting to know , because its not much heard of , guess it makes a dependent , and regarding for the future one might get in , helpful .

There is no age limit for an extension based upon being the parent of a Thai child. The last change to the police order eliminated the no funds option.

You cannot be a dependent of the child, you must show an income of 40,000 a month or 400,000 in the bank.
