Hi

Just a up date really I've posted on Thai visa a few times I married in April this year and sent the misses visa application off and after a tense few months her visa has come through it took just under 4 months thanks for the advice when I've posted not only on this visa . Know doubt I'll be posting soon

Congratulations.

Note that as she will be applying for ILR after October 2013 that the ESOL with citizenship course will not be acceptable evidence of her English ability.

Remember, too, that in her ILR application she will need to provide 6 acceptable documents spread over the entire 2 years ideally addressed to you both jointly, although a mixture addressed individually will do, to show that you have been cohabiting the whole two years. See section 11 of form SET(M) for a list of suggested documents. So if you haven't done so already it is a good idea to put your electric bill, phone bill, council tax etc. into joint names.

I Started straight away putting her names on bills ect once we married

Sorry i took so long reply ive been away working just a couple of Questions u could me with .

1.when we got the letter in with the misses passport and stuff it stats what she,s got to do to achieve to apply for ILR. It stats that she can either pass the kol or the esol course .

Is this a standard letter they send out ? i know under the new rules shes got to pass kol and B1 speaking and listening has she can only apply in July 2014

2.Bank account ive tryed 3 banks and they knocked her back because she hasn't beek here a year.

3.when are the ukba going to give us the information about the B1 where she got to take it ect

You don't have to be in the UK For a year to open a bank account . I have only been here just about 2 months and i got a bank account already . You said you've added your wife's name to all the bills , those bills with her name on should be good enough to get her a bank account ,all they need were two form of proof of address , proof of id

Keep trying different banks, even different branches.

I tried to open a simple savings account for our daughter (Thai passport) and was told that this was not acceptable for Barclays. On-line it made it clear that any valid passport was OK so sometimes it is down to the ignorance of staff at individual branches.

As this was not the only time that our local Barclays has been difficult in this sort of way accounts are being moved to Lloyds who were much more helpful!

Apols for not replying sooner.

1) Yes, it's a standard letter, which they don't seem to have updated yet.

2) As others have said; shop around. My bank wouldn't open an account in my wife's name when she first arrived, but they would open a joint account in both our names. This was actually better for ILR purposes.

3) Your guess is as good as mine.

Firstly try HSBC for a basic current account - worked for my thai Mrs with just a council tax bill, thai passport and thai ID card as proof of ID / Address ( she was on a fiancé visa at the time). Hopefully 7x7 or someone else can help me out with a tricky question now. My mrs arrived in the UK on 8th October 2011 with her fiancé visa, we got married in February 2012 and applied for her FLR which was granted in early march 2012. My question looking forward is will my wife be able to apply for her ILR late September 2013 just before the new life in the UK rules come in to force? Ie sit an ESOL with citizenship materials. She will at that point have been in the uk 23 months or will her visa be processed in October meaning she would need to comply with the new rules? Thanks in advance for any help.

As she arrived on a fiance visa she cannot apply for ILR until her FLR expires. As that will be Feb/March 2014 the new language requirements will apply.

Thanks for the quick reply 7 by 7 - Your a star. I wasn't sure if her months here as my Fiancee counted as part of her 2 years but you have confirmed my worst fears - Time for life in the UK school.

Do they have a date yet in October 2013 when the changes will apply. 1st October is on a Tuesday, would have thought changes would start at the beginning of the week.

Not sure if someone else finds this a little confusing or is it just me being vacant. I have just looked on UKBA website in preparation for my wife's next visa which is early 2014. As above she came here on a 6 month fiancée visa (landed October 2011) we got married February 2012 and applied for her FLR which was granted in March 2012 (same day service) The ILR section from the UKBA website pasted below confuses me because it gives the impression that she can apply for ILR under the old rules - Am I missing the point?

This section explains whether and how you can come to or remain in the UK if you are the partner of a British citizen or a person who is settled here. A partner includes husband, wife, civil partner, unmarried or same-sex partner.

Yes - your wife will qualify under the old rules, but she'll still have to meet the new language requirements as 7by7 states.

Thanks Wooloomooloo for the reply - I think that's the bit which has confused me - "The old rules" I looked at the big picture thinking that included the language requirement not just the financial.
