My kids are under ED visa and I am their tutor (I'm their mother)

We arrived here on august, 7th with 90days non ED visa.

Tommorow I'm going to immigration bureau tomorrow to ask for visa extension (until end of school year).

As a tutor, I need to show some documents, like proof of family relationship that I already translated in Thai language.

On the list of required documention, there's also a copy of bank book with amount of not less than 500,000 baht for the past 3 months.

I have this amount of money but since the 2 past month my account has been opened, the money up and down from about 350,000 to 500,000.

Do you have any advise to give me ? Is this can be a rejection from immigration office ?

I think you will be rejected, but maybe you are lucky.

Requirement is that the child goes to a Thai educational facility, in essence elementary or secondar school. I seriously doubt immigration will accept homeschooling.

Also the money has to be 500,000 baht continuously!

You will get your extension since it your first extension if you have maintained the 500K balance for the past 30 days. If not you will not get your extension and will need to leave the country and get a new visa.

2.11 In the case of being a family member of an alien who has been permitted a temporary stay in the Kingdom for enrollment in an educational institution according to Clauses 2.8 or 2.9 hereof (applicable only to parents, spouse, children, adopted children, or spouse’s children): Each permission shall be granted for no more than one year.

(1) The alien must have been granted a non-immigrant visa (NON-IM).

(2) The alien must have proof of relationship.

(3) In the case of spouse, the relationship must be de jure and de facto; or

(4) In the case of children, adopted children, or spouse’s children, said children, adopted children, and spouse’s children must not be married, must live with the alien as part of the family, and must not be over 20 years of age; or

(5) In the case of parents, funds must be deposited in a bank in Thailand, under the father’s or the mother’s name, of no less than Baht 500,000 for the past three months. For the first year only, the applicant must have proof of a deposit account in which said amount of funds has been maintained for no less than 30 days prior to the filing date.

2.9 In the case of enrollment in a private educational institution: Each permission shall be granted for a period certified by the educational institution, which shall not exceed one year.

(1) The alien must have been granted a non-immigrant visa (NON-IM).

(2) Said educational institution is permitted to operate by a relevant government agency.

(3) The alien must have been confirmed and requested by that particular educational institution.

(4) The alien must have been confirmed by the relevant government agency (except in the case of enrollment in an international school and higher education).

Your children will get their extension of stay without a problem, the rules for you are:

As this is the first application, you only need to have 500,000 in the account over the last 30 days before applying for the extension. But every next extension it must be there for 3 months and you cannot let the money get below 500,000 baht or you will be denied!

In case my request is rejected, what happen next ? I have my 90days visa ended nov, 4th so will have to leave Thailand on that date ?

You will not get your extension unless money has been in bank for 30 days. You can do your extension any time before Nov. 4th.

If you do not get the extension before the 4th you will need to make a trip to any nearby Embassy or consulate to get a Non-o visa based upon your children's extensions.

Yes, you will have to leave on that date.

But if you have 500,000 baht continously in your account on that date, you can apply for the extension on that date. No sense in applying now if the money wasn't there for at least 30 days.

OP mentions that she is her kids Tutor, does this mean yet attend school as well it does this mean home school?

I thought that in order for her kids to get visa or extension, they would need a letter from school which must be registered with Thai ministry of education?

Of so and OP means that she will home school her kids, couldn't this cause problems with her kids visa / extension?

If so, then wouldn't she then also have problems with then getting her extension as mother based upon Kids Ed visa?

If I don't have the 30days showing 500,000 baht in bank, I should leave Thailand and apply for a new 90 non ED visa (as parent) based on my children visa, is that right ?

In that case, which embassy I should go (I'm French) ?

30 is firm, but immigration has some discretion. But would not be eager to use it.

Your children will be fine, only you will have a problem. If 25 days you can ask for a 7 day extension and then apply for the 1 year extension at the end of those 7 days. Ask your local immigration office.

How long it takes to queue there ?

Yes, they need to apply in person for an extension of stay. Immirgation will also take a pic of them with a webcam.

For your own application it can be useful, but immirgaiton will understand that they need to go to school.
