Hi just a quick enquiry,

If my wife was to apply for FLR how long would she have to wait before then applying for ILR

The reason i ask this is her ESOL course runs over her current spouse visa by about 6 weeks and we really want to get her ILR in before the new rules in october

I presume she is on a 2 year settlement visa she may extend it if required and she can apply for ILR once she qualifies.

Indeed, if she has spent at least 24 months in the UK as your wife; i.e. with a spouse visas and/or FLR, then she can apply for ILR as soon as she meets the all the other requirements; including language.

Thats great i am hoping the college will let her do her ESOL exam 2 months earlier so she can put her application in just for ILR, before her

You can extend her current flr until she meets the standard and move onto ILR immediately.

In your wife's circumstances, that's correct.

Remember, though, that from October 2013 an ESOL with citizenship course will not be acceptable for ILR. Applicants from then on will need to have passed the Life in the UK test. and obtained at least level B1 of the CEFR in speaking and listening.
