Yellow-shirt group will rally to press govt to reject any negative temple ruling

BANGKOK: -- A yellow-shirt group will rally later this month to pressure the government to reject any negative ruling by the international court against Thailand on sovereignty of land around Preah Vihear Temple.

Chaiwat Sinsuwong said the Thai Patriots would hold a mass demonstration on January 21, but the group had yet to select a venue.

Chaiwat claimed his group had gathered 570,000 signatures from Thais to reject an anticipated ruling by the International Court of Justice (ICJ) on sovereignty of the disputed area around the temple.

The group expected to gather up to 1 million signatures by January 21. These would be submitted to the Supreme Court president and military leaders to pressure the government to reject the authority of the ICJ over Thailand, he said.

The Patriots Group would also file a lawsuit against the Foreign Ministry at the Criminal Court on January 14, accusing the ministry of disseminating false information by saying Thailand could lose the legal battle over ownership of the 4.6-square kilometre plot around the ancient Hindu temple.

Foreign Minister Surapong Towichukchaikul cautioned on Saturday that Thais should also be ready for possible disappointment in the court dispute.

Cambodia has asked the ICJ for an interpretation of the scope and meaning of its 1962 verdict that the ancient Hindu temple was located on Cambodian territory.

ML Walwipha Jaroonroj said the yellow-shirt group would use the petition to pressure the government not to give the 4.6-km plot to Cambodia. She said if Thailand accepted the 1:200,000 ratio map of France, the ICJ would definitely rule in favour of Cambodia.

Democrat MP Ong-art Klampaibul said the Pheu Thai government should have a clear-cut stand in the legal battle. Ong-art said the government should not blame the previous administration for the case because the current government had a duty to fight the court battle to its full extent.

How is "could lose the legal battle" false information?

Given that the courts accepted the maps in their 1962 decision, they are most likely going to accept the maps for their decision on the surrounding land.

Sounds like this lot actually believe that Thailand can never be in the wrong is actually written in to law.

Ultra-nationalists charge government with 'lying' about Cambodian temple

BANGKOK, Jan 7 – Beginning next Monday a Thai nationalist group will protest the Foreign Ministry’s handling of the Phra Viharn (Preah Vihear) temple dispute between Thailand and Cambodia.

Chaiwat Sinsuwong, an activist of the so-called United Front of Thai Nationalists and Saviours of Thai Territory, said the group will take its claims against the government to the Criminal Court and sue the Foreign Ministry for giving out false information on the Thai-Cambodian dispute to the Thai public.

The group will march to the Supreme Court on January 21 to officially ask the court chairman to consider the controversy, he said, adding that the group will submit a similar request to leaders of the three armed forces, seeking their cooperation in rejecting the authority of the International Court of Justice (ICJ), he said.

Karun Sai-ngam, another leader of the group, said it has collected 570,000 names of persons who will join the protest, expects to have one million signatures in two weeks.

Former foreign minister Prasong Soonsiri, also an executive of the United Front, said the country’s political and economic crises are reaching a boiling point and an anti-government rally by the people could be possible anytime from now. (MCOT online news)

I would have thought that if the disputed land was really Thai, the government should have forcible taken it many years ago. Why have interlopers on your property for decades? This government should either accept the judgement if not in their favor or fight to reclaim it.

You seem to be wrong. Thailand was party to the border negotiation with the representatives of the French and Indo-China. The the ICJ confirmed the border settlement as originally confirmed in 1962. It is Thailand that are the trouble maker in this instance and the ICJ will likely confirm that. Let me remind the Democrat activists that on their last rallying over the Preah Vihear issue led to the loss of lives of Thai soldiers for no advantage to Thailand. The Yellow Shirts, so called Royalists and Patriots are a bunch of musket waving has-beans that discredit Thailand. Remember it is Thailand's neighbor that has sought legal clarification of the issue. Thailand simply never appealed the 1962 judgement. Why? Probably because they accepted it as reasonable and just.

The one thing we can be certain of is that none of those leading this agitation will be anywhere near the fighting should it break out. They will leave that to the sons of the "little people" who were unable to buy themselves out of the draft.

The Thais have accepted the 1962 decision ... which was that the temple is in Cambodia.

What the 1962 decision didn't say was anything about the surrounding land. That is still in dispute.

One of the main reasons the court didn't rule on the surrounding land was the Cambodians (who took the case to the ICJ in 1959) didn't ask them to. They only asked them to rule on the temple because the Thai army was stationed there.

Activist group seeks government rejection of ICJ ruling on border dispute

BANGKOK, Jan 8 – The anti-government People’s Alliance for Democracy (PAD) petitioned Prime Minister Yingluck Shinawatra today, calling on her administration to defy the pending ruling of the International Court of Justice (ICJ) on the contested land surrounding Phra Viharn (Preah Vihear) temple over Thai and Cambodian ownership.

Panthep Puapongpan, a PAD spokesperson, said Thailand must clearly display its stance against the ICJ judgement and jurisdiction, and refuse to sign any agreement as a result of the court’s order.

Thailand and Cambodia are scheduled to give their oral statements on the dispute at The Hague, Netherlands, on April 15-19.

“Thailand has completely abided by the ICJ’s order. It is not necessary to follow the ICJ’s injunction,” he said. “We are not organising any activity at the moment while watching the government’s direction. If the government follows the ICJ’s order, it is tantamount to intentionally let go of the Thai territory.”

Deputy Prime Minister Phongthep Thepkanchana said the Thai legal team will meet with foreign legal consultants in London next month to prepare the oral statement for presentation to the Court on April 19.

The legal consultants have been given full authority in fighting the case for Thailand’s ultimate interests, said Mr Phongthep, appointed by the premier to supervise the case. He is also education minister.

He said the legal team, including its foreign consultants appointed by the previous government will pursue the case.

The government welcomes suggestions from the Thai people and any organisations concerning the case but final decision depends on the judges, he said, warning against creating negative attitudes towards Thailand.

“Judges are human beings. Their negative attitudes will be unfavourable to Thailand. We will fight to the utmost. We are fighting for the other part of the territory which they (the Cambodians) have claimed ownership. If the court dismisses (the Cambodian) complaint, we will be back to the status quo of the ICJ’s ruling in 1962,” he said.

In its 1962 verdict, the ICJ only ruled that the temple belonged to Cambodia but there was no judgement on the 4.6 sq km of scrubland surrounding the temple. Thailand has claimed ownership of the land, reasoning that the border had never been officially demarcated.

The dispute between the two countries erupted again shortly after the UNESCO approved Cambodia's bid to have the temple named a World Heritage Site on July 7, 2008. (MCOT online news)
