Can anyone help me with this?

My Thai girlfriend is with me now in Perth on her second tourist visa, we go back to LOS in April so after proposing to her on the Indian Pacific last week we are preparing our Prospective Marriage Visa application. I read somewhere in this forum that it helps to have the medical and police check done before you lodge the application, But I also read that you need to get a letter from the embassy to take to the Police and maybe also one to take to the doctor before you can get the checks done. I am only over in LOS with her for three weeks before I come back to Perth and would like to get as much done as possible while we are both there.

Can anyone let me know the fastest way to sequence things.

For the first part above in bold. Its best to get everything done before you go. Though you can submit things as you go. As my wife is currently applying at the moment i know this. They told her she can do this but will take longer.

Second point. No need to wait. She can go and apply for her police report when she is back in the country and takes up to 10 days to get back. But usually it doesnt take this amount of time. But you will not get it in a day or 2. As for the medical then you can only do this with the forms that come with partner migration kit. Do you have this? If not i suggest get this at any Oz Embassy or can be downloaded from their site. The links for Embassies is a sticky at the top of this forum. Hope this helps.

Jockstar is correct,just like to further that,if you get a list of Hospitals,doctors that perform the medical examinations from the Immigration web site they will already have the required forms.

Just another tip on the examination,make sure your fiancee is "NOT" on her monthly when she goes for the examination or you could be in for a double up on examination fee's as urine contamination can give an immediate failure as in our case!

Good luck Spike and just remember mate,be very patient as its not a fun thing to go through,in fact it's very trying on the nerves and at times you can feel fustrated,but I'm sure you will enjoy the spoils of the results.

all the advice is good so far, as AG said it's sometimes a frustrating procedure but well worth it, my wife is nearly at the citizenship stage now but I remember the early stages of getting the visa and then the permanent residence stage, after that it's all too easy.

Use the partner migration booklet as suggested by jocky, it has everything you need to make the correct application and follow the checklist contained within b4 you lodge application.

One other thing to note, if you return to LOS while in the 309 visa status you need another police check, covering the time you spend there, so allow time to do this, the report can be sent to you in Oz for a small fee so it's no big deal just time really.

One other thing to note is if your wife has dependant children (as defined by Oz law) then they must also get a medical whether they are applying for a visa or not.

Thanks for the help Guys

I have looked for the partner migration kit you mentioned but can only find the partner migration booklet and this seems not to have the health check form. Maybe I am missing something ?

read the book it contains all the info you need, page 18 tells you about the medical requirements and relevant fact sheets. We obtained our forms from the embassy in BKK but this link may help.

I'm from Perth too, getting our Application ready to submit in BKK (in April too).

(spouse Visa)

I've been working on it now for about 2 or 3 months.

You must read the checklist in the back of form 47sp very carefully.

It doesn't look like you need much at first ... until you start work on it!

I did not realise just how much work was needed to get all the info together.

Just a note: If you intend to bring her back to marry in OZ then you have to have lived with her

for 12 months already (without a break).

That's why we got married in Thailand -last trip.

Then the 12 month rule does not apply.

However the problem is getting together all the "Proof" that you have a genuine relationship.

As you know they are very tough on that one.

Anyway you could get a 3rd Tourist visa (assuming each one so far was 3 months)

After that they seem to insist on an immigration visa, no more "tourist" visas.

The extra visa may be required to give you more time to get all the paperwork done.

Spike if you ring the department Of Immigration and order a Migration Package,which includes every form available to migrate(including stuff you won't use) all the medical,police clearance etc etc forms are included,the cost of that is I think about $12-00 but well worth while.can pay by credit card and they will send it out immediately,mine took 2 days and I'm in Brisbane.

Just one correction to your post for the Prospective Marriage Visa you only need to have met in person(this is to stop internet marriages) its only for spouse or defacto you need to have lived together for 12 months.

Thanks for the advice. the medical forms they talk about (form 26 ) is only for use in Aus, I get the feeling that you can only get the Thai medical form at the embassy or the Visa center in Bangkok.

That means if I met a girl in Thailand and proposed to her,

I could apply for a Fiance Visa the same day?

I assumed that the immigration dept. are trying to prevent people entering Australia

for some other purpose than a genuine marriage.

I think the problem has been that many ladies arrive in Australia and for one reason or another soon separate from their "sponsor" and become illegal aliens.

I think this ploy has been used by mafia types to import prositutes for brothels in Australia.

I thought that's when they would use the 12 month rule .. it would be logical ..

Evidently the immigration department waste a lot of resources tracking down illegal aliens and that's the reason why they insist on you proving that you have a genuine relationship?

The 12 month rule only applies to the de facto side of the spouse application....if you are legally married for 6 months you can still get the visa without having lived together first. However in this case you would still need to provide proof of a relationship from before the marriage date.

The fiance visa comes with the proviso that you will get married within 9 months of the grant of the visa....you could be liable for penalties if you do not go ahead with the marriage and your missus could get deported.

It would be likely that if you met her and applied for the fiance visa the same day, the visa would not be approved as there is no evidence of an ongoing relationship....photos, letters, birthday cards, phone bills, proof of financial support.

But just to confirn, for the police check we just have to turn up at the police office on Rama Road and ask for one, do we need to bring anything apart from her passport and ID card.

Requirements for a Police Certificate

Apply to Commander Special Branch

Royal Thai Police Headquarters

Rama I Road, Bangkok

Provide:

3 passport photos

passport

letter of introduction (get from Australian Embassy or Visa App Centre - CC Tower)

ID card

Household registration
