I found a message on Thaivisa about a good lawyer with the necessary police and prosecutor connections, who can make the police arrest a fraudulent person, and possibly deny bail in case it is a foreigner. I did send a pm to the poster, but the last time he was active was in January 2013, so I am not sure when he will be back. Meanwhile I need to move on.

This is a clear case of fraud, with sufficient evidence. My lawyer prefers a criminal court case (with her as my lawyer) instead of going straight to the police, and let them take care of this matter.

I need a good lawyer with the necessary contacts to accompany me to the police station in Bangkok, in order to arrest this conman, and get my money back. Please pm me.

Owch sorry to hear about your luck. Is there any info you are willing to share with us on the con? I would hate to think of myself or others getting stuck in it as well.

I also want the lawyers contact info to report a crime in progress by a British woman infecting children and operating illegal restaurant with no license and no work permit or license to drive the motorbike she stole in Bangkok

She must be stopped

Dear Scottythai, for now I am not at liberty to divulge more, as the other party may have access to these messages as well. After the completed arrest I will be able to disclose more. Any valuable information is highly appreciated. Please pm me.

"I can't talk about it but it is really important so help me sort this thing out, that I can't talk about, but you should be careful, about this thing which I have not spoken of..." I really only read TV for the psychodrama.

How many lawyers do you need? 1 is not enough?

Personally i despise people like you, who want to report someone for "not having work permit"

Illegal restaurant? without a license? you mean she did not pay 1000 baht for laminated piece of paper?

Ever wonder why the "good" lawyer you found stopped responding after getting your PMblink.png

Dear Frits, one lawyer is enough. A lawyer who is willing to go to the police with me. My current lawyer does not want to accompany me to the police, as she prefers to start a criminal court case on my behalf. That way she could bill me more and longer. But what I heard is that the way to go in a case of fraud is filing criminal charges at the police station, with the police hopefully arresting the criminal, and then prosecution would start a criminal case. So one lawyer is needed. And it would not be the current one. Any constructive help is appreciated. Please pm me. Thanks.

I believe you are talking out of your backside.

NO lawyer on this planet can start criminal case without police.

If lawyer files a case it is civil, when police file a case its criminal and prosecuted by the state.

Dear Lemoncake,

Herewith I quote Siam Legal Lawyer's Office 'The overwhelming number of criminal reports have resulted in delays in investigations and prosecution. As a solution to this, private citizens have been allowed to come to hire lawyers who will directly file the criminal case in courts, instead of taking the police reporting route. While this is a more expedient choice, the private party of course bears the consequence of bearing the costs of the private case filing.'

i can not comment on siam legal as they are the sponsors, however look up definition of criminal, a private citizen can only file civil case, police determines what is criminal and what is not.

but stay with the reputable firm you quotedthumbsup.gif

OP: prior to proceeding you should consider the following:

Criminal Defamation

Defamation as a criminal act in Thailand is defined by the Thai Criminal Code as a statement made by a person who imputes anything to another in a manner which is likely to impair the reputation of the latter or to expose him to hatred or contempt. Under the same Code, such person is liable for an imprisonment up to two years or he can be ordered by the court to pay a fine of 200,000 Baht or may be both.

Burden of Proof and Available Defenses

In Thailand, it is not the duty of the victim or the prosecution that the statement made by the defendant is false. Hence, the burden of proof lies on the defendant to prove that his statements are true. The defense that the defendant did not know his statements to be false is not acceptable in Thailand. Regardless of the truthfulness or falsehood of the statement, once it became a source of an injury which caused damage to the victim, the defendant is liable.
