The article says there are many witnesses who say she was blind drunk and out of control on the night of the alleged rape.

She came into the restaurant with two foreigners who tried to get her to leave with them but she refused so they left without her. She was later ejected from the restaurant by the staff for bothering the other customers.

The most compelling witness testimony comes from 33 year-old Miss Noi Raksachon who lives on the 2nd floor next to where the alleged rape took place. She said she saw the girl on the 2nd floor in a drunken state, crying loudly. The girl was alone the whole time. Miss Raksachon got up at 03:45 unable to sleep because of the noise and sometime after 05:00 she saw a Thai male approach the girl and suggest she go downstairs where it was safer but the Scottish girl went berserk and chased him off.

Miss Raksachon only later found out there had been a rape allegation and said in her opinion she would have heard it if it took place and nothing out of the ordinary occurred that night except for the girl being extremely drunk.

The police are waiting for the results from the hospital and if they show that a rape didn't take place then they will prosecute her for making a false allegation damaging to the reputation of Thailand.

Tourist's rape claim disputed

Nakhon Si Thammarat February 20, 2013

Several witnesses have told police they spotted a Scottish woman on the night she claimed she was raped - but they did not see any man approach her or use violence against her.

Nakhon Si Thammarat police interrogated several witnesses who said they saw the tourist at three restaurants where she drank and at the apartment building in which she stayed. All said they had not anybody threatening or attacking her.

The 20-year-old filed a police complaint saying four men had raped her on Friday night - a story that has been widely reported by foreign media.

Nakhon Si Thammarat police chief Pol Maj-General Ronnapong Saikaew yesterday convened a meeting of senior officers to discuss the progress of the investigation. The meeting was told several witnesses provided the same testimony - that they did not see any man approaching the woman.

Another two witnesses were invited to testify - an engineer of a petroleum firm in Malaysia and an executive of the Jamaica Restaurant where the woman drank. They said they remembered the woman well because she was drunk while with her friends, who were also tourists.

Pol Lt-Colonel Niti Boonchan, deputy commander of Muang district police station who is heading the investigation, told the meeting that he also interviewed witnesses from the Jamaica Shop and the Nakhon Viengchan Shop - the third place the woman drank. All testified she was drunk and quarreled with patrons.

After this meeting, the Nakhon Si Thammrat police chief visited the apartment building where the woman was staying and spoke to Noi Raksachon, 33, whose room was next to that of the Scottish woman.

Noi said her neighbour's swearing woke her up at 3.45am, and then she heard a man come to the woman's room at 5am and asked her to go downstairs for fear she might fall from the room's balcony. But the woman yelled at him, prompting him to leave.

Noi said if the woman was being raped inside her room, she would have heard calls for help.

The building is connected to the Nakhon Viengchan Shop with a second floor walkway. Jatuporn Mongkolkarun, the shop owner, said she had a security officer walk the woman to her room.

Pol Colonel Sompong Tiparpakul, commander of Muang police station, said police are still waiting for the results of physical checks on the woman to confirm if she had been raped.

Regardless of whether the story is made up to make the alleged boyfriend feel guilty or if she was in fact raped - this story is a tragedy. I for one would never leave a girl alone like this, nor would I entertain a female with the attitude as described by witnesses. But there's a big part of me that hopes she was never raped, no one has ever deserved that.

The testimony from restaurant witnesses is only relevant if the general area is small enough that they would expect to see anything. Of course four guys in a pick-up truck didn't attack and drag her off to be raped while she was in or near a restaurant with customers looking on.

If they're choosing to use the wrong witnesses to back-up a false complaint story that's going to make it very hard to believe them, or believe they will carry out an honest investigation.

The sperm, or lack there of, will prove valuable. (I'd reckon the girl next door would hear the commotion if there was consensual sex involving 4 guys too, which she makes no report about)

This would not be the first time that The BIB have tries to take an investigation away from the truth, if they thought it would damage the reputation of Thailand. I've got an open mind on this, lets see what happens. Sadly though, always skeptical of The BIB given their track record.

If the story is made up, a tremendous amount of damage is done to legitimate complaints.

Very valid concern.

The BIB, as well as some "victims," have bent the truth, to suit their agendas.

It makes believability in what anyone says difficult.

There are. A foreign woman last year spent 15 days in jail after admitting to filing a false rape report. It's best for this Scottish woman to leave immediately if she's not telling the truth.

If it is truely a false report then the BIB are going to get pissed at farangs in the future and not take anything seriously.
