Looking After The Kids...still Need To Show Money?

Suppose one has been here on One-year 'O' visas for many years for marriage purposes with a registered marriage.

If the wife goes and lives with another guy, but no divorce, can one still stay and look after the Thai nationality kids from the marriage?

Does that still need money in the bank or 40k monthly amount?

Getting difficult to make the 40k now the GBP is dropping like a stone.

What options if less than 40k?

Overstay seems to be the only option to me....been here 21 years and no desire to leave.

If you have legal custody you can stay on that basis but does require the same financials as marriage and will not normally be approved while still married.

Alternative would be non immigrant O visas for 90 day stay but a multi entry is not normally available for child but for wife if she can provide copy of her ID card and home register every year is currently available from Savannakhet without financial proof or from KL in Malaysia with proof of 100k in bank account. This would require exit/return every 90 days but otherwise easy process. Beyond that would be tourist visas or visa exempt entry's at border for shorter periods.
