Hi,

We applied for a settlement visa and my wife just got her visa but it reads...

Type Visa Spouse/CP - Spouse/CP of MyName

I've found a couple of threads but still confused if anybody knows please?

We have been married for 10+ years.

Cheers,

Jeff

Thanks 7by7,

I read that it should have said 'Settlement' and 'KoL Req'

Are these differenct classes of visa please?

Cheers,

Jeff

If she had been granted Indefinite Leave to Enter as your spouse then it would say one or the other, depending on whether she had satisfied the knowledge of life and language in the UK requirement or not.

Prior to 9th July 2012, if a couple had been living together outside the UK for at least 4 years then the non British spouse/partner would be entitled to ILE. This is the same as Indefinite Leave to Remain except it is issued outside the UK and ILR is issued inside. (Both called 'Settlement' by the UKBA.)

BUT:-

ILE for spouses/partners was abolished for applications made on or after 9th July 2012, I'm afraid.

Thanks again 7by7,

The visa has been issued for 2 years and 9 months.

So it looks like this is beacuse of the new rules. Would she be able to apply for ILR as soon as we get there?

Cheers,

jeff

No, as said ILE has been abolished for spouses and partners.

After 30 months in the UK she will need to apply for Further Leave to Remain and 30 months after that she will be able to apply for ILR.
