I am currently employed in Thailand but am hoping to get another job lined up soon, also in Thailand. I am wondering what the best option of cancelling my WP and Non-B is. I have the concern that my current employer may withhold salary or play other games, for this reason I am considering 2 options, unless someone can suggest another more useful one.

Option 1: Take the chance that my current employer will not make life difficult for me, cancel my work permit and non-B through the usual channels and do a visa run to get a non-B for my new employer, come back and start the extension of stay and work permit process again for my new employer

Option 2: Simply up and go, returning back to my home country for an extended holiday until my new job starts. Once back in my home country I have the option of applying for a non-B or returning on a tourist visa and getting this changed to a non-B through my employer.

With option 2 I am uncertain how my WP and Non-B would be cancelled and if I will cause any potential problems down the line. Would my non-B with extension of stay be cancelled upon departure at the airport? Could I cancel my WP with my employer on my return and on a tourist visa?

You need to cancel both before leaving, with a letter from your employer clearly stating the last day of employement.

You cannot cancel you WP upon return, that would be too late.

If your employer refuses to pay you, you simply inform them that you will report it to the labour office. if need be the labour office will take your employer to court on your behalf. Most employer chose not to let it come that far.

Concur with Mario and your option one. If any documents are missing you are closer here to get them than in your home country.

If you do not get a new non B you will be on overstay. Next week I have to do the same. Changing employers, although just got a Non B extension for a year and W.P. entension for a year.

2 years ago I changed employers and provinces and did nothing, when Immigration became aware they wanted overstay money, but luckily I was able to avoid it and pay 1,900 for 7 day extension to get papers for new employer. Overstay fine would have been 17,000Baht.

Old previous employer did not pay me housing allwance as stated in contract, Labour made them pay me, although I went to them 2 years after the fact, for various reasons.

OP are you on an Extension of Permission to Stay from your local Thai Immigration Dept or are you on 90 day Non 'B' Border entries? Makes a big difference.

If you are actually on a Multiple Entry Non Immigrant 'B' Visa with 90 day border entries, then this is unaffected by job changes and cannot be cancelled.

Either way your WP must be cancelled, but if your employer is playing games, you can cancel it your self at Labour.

digitalchromakey - I believe its the commonly held non-B with extension of stay, I report every 90 days at immigration. I do not believe I am on any kind of multiple entry non-B (never heard of this in fact). If I was to cancel the WP myself, how would I then go about cancelling my non-b and extension of stay stamp?

You must cancel your extension of stay as it ends the day your work ends. You are reporting to immigration every 90 days to file a TM.47 address reports I guess - if you had a multi entry visa you would have to depart every 90 days.

The day you stop work, cancel your WP at Labour, plus cancel your Extension of Permission to Stay at Immigration - leave Thailand that day otherwise you will be on an overstay.

If you are on an extension, then your Non 'B' Visa is almost certainly long since expired and does not require cancellation.

If you need a few days to sort out your affairs then you can get a 7 day extension from Immigration for 1900 THB on the same day that you cancel your current extension.

You forgot the perfect option 3.

Get your new job added to your existing work permit.

Then afterwards remove the old job from the work permit.

Requires a very helpful old employer happy to keep you on the books a little longer though!

Fine when you add another company, problem with this approach is when you come to remove job #1 from your WP (regarded in my area as your 'main job'), Labour will then insist the WP is cancelled and a new one applied for.

Carry on with two companies in your WP and you will need 2x sets of permissions, tax, company documents, etc, for extension and it's a nightmare.
