Here is my situation;

I'm planning to apply for my first non-B visa extension this week at immigration in Changwattana. I have a work permit valid for another 10 months.

Basically my company has been set up for 4 months (since March 2013) and we are currently finishing up renovating our office and ordering equipment (it is a "specialised" engineering company so very capital intensive and not a lot can be bought off the shelf and obviously there is a lead time of a couple months) so we have not yet started operating and hence no revenue as of yet.

The lawyers informed me that there might be a problem with regard to my extension as there has not been any revenue for 4 months and advised me to issue bogus sales invoice amounted to cover all my costs, which is the direction I really do not want to head into.

Does anyone ever heard of or have problem with the fact that your company has to start making money pretty soon after you start off? Well I don't think 4 months is a long time to spend setting up your company from scratch.

Oh well this is Thailand. Please advise how I can sort out this mess.

You will not be able to extend your stay without financial documents for first year of operation AFAIK. So a multi entry non immigrant B visa would be your best option for first year and is only available at most location when you have a long time remaining on work permit.

If your lawyer is advising you to issue false documents, I'd look at finding a different lawyer.

It has been many years since I started my company but, like you, I spent a long time getting things set up. I never had a problem with visa renewals in the first few years when we were showing no revenue/loss. Immigration may ask for some back-up documentation but I wouldn't automatically assume that you are going to have a problem.

He will not obtain extension of stay with a new company. The employment extension under section 2.1 of Police Order 777/2551 includes the below which will not be available.

7. Copy of balance sheet and profit and loss statement for the latest year, together with income tax
return for companies or juristic partnerships and payment receipt
Attachment to Order of the Immigration Bureau
No. 305/2551 dated December 3, 2008
