Thailand to become party to Madrid Protocol to protect IP rights

Featured Replies

Guys!

The Madrid Arrangement and the subsequent Madrid Protocol have NOTHING to do with design, copyright etc. It's just TRADEMARK REGISTRATION PROCEDURE, not even the scope of protection of the trademark is changed, only the procedure to get a registration in other countries.

Cheez! Inform yourself before you post some totally off-topic remarks.

Appears the Madrid System is to Trademarks as the Berne convention (Thailand is a member) is to copyrights. The TRIPS (Thailand is a member) is also associated with trademarks but perhaps for enforcement rather than registration.

TRIPS stand for Trade Related Aspects of Intellectual Property Rights and covers all IP (Intellectual Property) rights and some minimum protection adhering stated must afford its citizens. So, yes, trademarks and copyrights (as well as patents) are covered by TRIPS.

But TRIPS does not deal with the registration procedures. Madrid Protocol deals exclusively with application and registration procedures.

Actually, while the Berne Convention as well as the Universal Copyright Convention define the substance of copyright protection, the Madrid Arrangement and the Madrid Protocol only deal with the application and registration procedure and do not define the scope of protection of a trademarks. That is left to the national laws.

Insofar, the Berne Convention and the Madrid Protocol are quite different.

Please also note that in most countries copyright protection does not require an application or registration of the object (US being a prominent exception.)

Also the term "copyright" is kind of unfortunate as it does not convey the meaning of the right as granted by continental Europe, where Copyright is a protection of an artist's work and covers more that just the right to copy.

LOS is also a member of CITES....as for what good that means is up for grabs.

The 1989 Madrid Protocol on 1891 International Registration of Marks (as in Trademarks) is administered in Geneva, Switzerland.
