Wanting to change jobs; how to do this with workpermit?

Featured Replies

Hi,

am currently employed with a company, although, they did let me sign a contract for the probation period, which ended last month and so far I have not received a new contract. Now I want to change companies; how best to handle this.

Can I just quit, since I never got a copy of the old contract and my probation period is over without receiving a written confirmation if they want me to stay or that I can go. And what consequences does that have for staying in the country?

Perhaps somebody can recommend me a good labor lawyer?

I would give them 30 days written notice. If you are here on an extension based on employment, your permission to stay ends on the day your employment terminates. You,most likely, will be able to get a 7 day pack out extension for 1900 baht. Your employer must give you termination papers to cancel your work permit and permission to stay. When you get a new job you have to do the process all over again unless you can do it during your 7 day "pack out" extension.

The question is if you are on an extension of stay from immigration or on a 90 day entry with a non-B visa.

You do not need a lawyer, if your employer doesn't pay you you go to the labour office and they will sort it out. if necessary they will take your employer to court. Most don't let it come that far.

Working without a work permit is illegal, but in case of a conflict with the employer they will not hold it against you.

OP, do you have a WP? If you do, your employer had to give the Labor Office a contract that goes to at least the date your WP ends.

The contract would have been in Thai, and often not exactly what the employer has given their employee in English.

Agree with above, give 30 days notice and you should be okay.

Do have a valid wp and just reported my 90 days, so next report should be in November.

Will give them a written leave, thanks for the information.

Then you are probably on an extension of stay and must visit both immigraiton and the labour office to cancel.
