I'm in desperate need of some help with visa information. I'm a 43 yo Australian and I have a six month old baby girl with my Thai wife, we are married but not legally with paperwork. I don't have 400,000 baht and I haven't been earning 40,000 per month since coming here in January so I entered Thailand on a thirty day tourist visa and then applied for a double re-entry visa in Lao. I missed the first extension after two months but was given a sixty day extension at the end of the second re-entry because I have a daughter with a Thai woman.

On the 25th of August the extension ran out so I went to Cambodia and of course my passport was stamped for 15 days so in six days this will run out again. What are my options? Is it possible to file for any visa to stay here longer as I have a daughter who is a Thai national. I have been reading on here and it looks like a multiple entry visa would suit me better be they can't be applied for within Thailand, is this correct? Am I able to apply for a double re-entry visa again in Vientiane? Going back to Australia even for a short time is not so easy at the time. What do I do?

You can only get a multiple entry visa if you are legally married or the legal father of the child. (Although I wouldn't get my hopes up very high for a multiple entry based on having a child in Asia).

Your best options are to either officially marry the mother or legalise the child.

With birth certificate you could try to get a single non-O in Savanakhet, though no guarantees. Consulates are now instructed to check that you are the legal father of the child before issuing a visa. You might get a new double entry tourist visa.

If you can afford it, go for an ED Visa. You can stretch it out to 3 years or more (I'm on year two of my 3 years worth of extensions) depending on type of school, course etc. Thagt could give you lots of time to sort other things out.

It appears if i tried to apply for a single non-O visa I have a high chance of being refused as I am only listed as being the father on my daugters bith certificate at this time. I might get a new double entry, but that is also a might hmmmmmm.

If it is possible to get another 60 day extension that would be the easiest for me right now but on what grounds can i get that? Is it because i missed the first extension you say that? Also on what grounds can i get a single Non-O visa? The above post by Mario said i might be able to get one. I thank both of you for your help anyway, I hope you or someone else might be able to respond further to explain a bit more about extensions and the single Non-O visa

You can get a 60 day extension based on your child on any entry you make into Thailand. (But some immirgaiton offices sem to set a limit).

On show of the birth certificate, together with a note from the mother and a copy of her ID card asking for a visa for you and confirming that you are taking care of the child they might give you a single non-O.

If not, they might give you a double entry tourist visa in Savanakhet. Criteria is more how many toruist visas you already had. Normally they will issue about 5 of them before they tell you to go elsewhere.

The chances of getting a single entry is very good. They normally only enforce the parenthood issue for multiple entry visas.

It is similar to immigration doing 60 day extensions but not one year ones.
