work non-b rules enforced ?

Featured Replies

A non-b - extension - based on work expires automatically if you change work or stop working.

I once felt forced to do a very sudden visa run because of these rules. When I came to the border, however, imm. police was surpriced, almost suspicious, over the fact that I suddenly wanted to leave the country "cancelling" my b-visa. Maybe they thought I was on the run from something.

Are the rules for non-b based on work enforced ? Has anybody ever been charged for overstay based on these rules ?

Only extensions of stay have immediate end with end of reason for them - a normal 90 day visa entry remains valid. And if on extension that needs to be formally canceled by immigration prior to exit of Thailand or you may indeed be questioned at exit point if they notice leaving without a re-entry permit (they are actually trying to be helpful so you do not make a mistake and lose you extension due this missing re-entry permit).

Officially you should cancel your extension on the day the WP is cancelled.

At that time you can apply for a 7 day extension to give you time to leave the country.

Leaving the country without cancelling the extension is possible but can create problems when you want to apply for a new WP in the future.

Actually believe it is last day of work - regardless of when the work permit is returned - that the extension ends. Without work the extension reason has ceased and that is the reason for it ending.

My information says cancellation of WP.

But maybe this is not a 100% correct translation.

Work permits and extensions have not been tied for years AFAIK. In a perfect world expect WP should be canceled and then the extension but it is an employer letter to immigration for extension cancel that is required from reports I have read - nothing about Labor being involved in that process. Many people do not even return there work permits - it is the work permit non cancel that is the problem if they try to obtain a new one later (and a fine is imposed).

lopburu,

I don't know if your comments where addressed to my post but i tried to explain the same you mentioned.

Only so far i know you need the labor office WP cancellation confirmation receipt (not employer letter but it may be accepted) to show to the immigration office to cancel your extension as they are indeed not linked in any other way.

Thanks. It seems that the situation is almost the opposite of what I feared; there is little reason to panic if you tell your Thai employer what you really think of him and walk out.

From my exxperience most people are lazy about whether you did this or that or had the employer write a letter or hand in your W.P. Immigration does not talk to labor as a rule, but I am sure they could easily.

I think I have handed in all my W.P.'s never with a letter unless I wrote it saying I was leaving. Try to follow the rules, but yes I am sure that they are enforced when and where deemed necessary.

No one wants to bring you problems, but we can unwittingly find them ourselves.
