I am Sebin, from India. My wife is a Thai national (marriage not registered), and she has gifted me with a beautiful 6 year old baby girl.

I have lived in Bangkok for the past 9 years and 6 months on a student visa for the first 4 years, and on a business visa for the latter 5 years and 6 months of my stay.

In July this year i got a better job opportunity in India, and ever since i have been travelling to Bangkok on a tourist visa.

I have got all the necessary documents from India for registering my marriage. The documents still needs to be further approved by the Indian embassy in Bangkok.

It now looks like a lot of time because of the red taped system we have in both the nations.

Is there anyway i can get a Thai visa based on my daughter’s birth certificate that has got my name on it? Or simply put, can i get a Thai visa based on the father -- daughter relationship?

Any and all information would really help me and my family back in Bangkok?

You can try to get a visa based on your parenthood, with the birth certificate.

The birth certificate itself is not proof of legal parenthood, so you will not get extensions of stay from immigration in Thailand based on that. But most Thai consulates will issue a visa based on the birth certificate.

You cannot obtain visas here you have to get them from an embassy or consulate.

You could get a 60 day extension of stay at immigration to visit your child.

To get a one year extension you would need to legitimize your parenthood since you were not married when your daughter was born. It would be best to register your marriage and then get the extension based upon marriage.

Once you have the affirmation of permit to marry from your embassy registering the marriage is easily done.

Once married you could apply for a change of visa status to get a non immigrant visa entry. At that time you would need to show 400K baht in a Thai bank or 40K baht income.

Then after 60 days you could apply for the extension of stay.

In the first part you state the marriage is not registered, then later it is, which is it? Do you mean your marriage is not registered in India?

You have to hire a lawyer and do it through a Thai court. I think you will find that registering your marriage would be easier.

Thank you, the Thabian Somrod is taking more time than expected as i had mentioned, and specially now when I am working full time in India. This is why i wanted to know if there is a lesser time consuming method based on father -- daughter relationship.

It can take months to get to the legitimization done.

Sorry if I was not clear, my marriage is not registered both in India and Thailand, and now because I am working full time in India, the whole process of registering the marriage in Thailand has become painfully slow.

yes, that is the thai word for marriage certificate.

That is not the affirmation of permit to marry. Once you have that you have it translated to Thai and have the translation certified at the Ministry of Foreign Affairs (translator can do this).

After that is a short trip to an Amphoe to register the marriage.

Thank you, so it seems marriage registration is indeed the way to go about it.

How much time do you think it might take for the whole process, if i take a brake from work?

Please keep in mind that i will be flying in with a tourist visa from India or on arrival. so will it be even possible to try get my marriage registered with a tourist visa stamped on my passport?

The tabien somrod is the official marriage certificate, you get when you officially register the marriage at an amphur.

As said, registering the marriage will be easier, quicker and cheaper.

Entry status can be tourist visa but the question is your Embassy requirement for paperwork to issue the letter that you are not married and suitable to marry. You might want to call them for requirements. For most single people it is just a filling in of two people/address in home country who know you and parents names and that you are single and job. Takes only a few minutes. For those with divorce that paperwork would be required. But some Embassies require paperwork from home country so can takes weeks for them. Once you have that paper one/two days is all you need to get it translated/registered and visit a District Office to register the actual marriage.

Time frame:

check your embassy website and see what documents you must bring them to get a affirmation of freedom to marry and apply.

Next you have the letter from the embassy translated into Thai.

Now you must have the letter from the embassy and the translation certified by the Thai foreign ministry. This cost 400 baht and for 65 baht they send it by EMS to your home in about 5 days.

Make a copy of the documents, immigration might want a copy of them at a later time

When you have done that, you can go to any district office in Thailand together with your wife to be and her Thai ID-card. The marriage registration takes about half an hour.

The Thai regulations requires me to produce a letter attested by the Indian embassy in bangkok which says that i am not married.

The Indian embassy in turn requires me to produce an affidavit approved by a 1st class magistrate in India, which says that I am not married. I have got this affidavit.

So it should just be whatever time it takes at Embassy to process the letter - add a day or two for the translation/MFA registration and short visit to register the marriage.
