Thai law will never, under any circumstances, settle in your favour against a Thai national. Anyone who tells you otherwise is either deluded or trying to con you. Forget any idea of legal protection, because in Thailand you have none.

Total rubbish.

In connection with my own marital ordeal I have been told by some educated, middle-aged Thais that

farangs are not accorded equal footing in Thai courts. My own lawyer and official asian-region observers

state that the Thai legal system is a "total mess, and requires total restructuring." The police are only very loosely bound by the law. The fact that Thailand is a fundamentally lawless land is at the root of Thailands endless political turmoil.

Why worry this at all? If it is not clear, then it probably is not going to work out the way you wish. By renting (not putting down a large sum of money in the land of schemes) you protect your nest egg. Invest in whatever you like, because it is going make more money than you ever will from the house. Leaving it to the kids upon your death.... Just consider it pawned/sold already. Better to invest and leave them the key to the safe. For the most part, with brokers, 2nd mortgages, lawyers and greedy relatives....a house/property (here) is not a good investment for a farang. It may work in you own country...so how about that?

Renting is worry free, and your assetts are not tied up in a foreign property in a country that is not really worried about you losing it to a Thai National. Rent yourself the home of your dreams...and sniff the freedom. Money in the bank.

There are tons of empty houses up north. My gal's sister owns about 18 homes and 100 rai...none of which can be sold for a fair price....and most have been 2nd mortgaged/or pawned to a China money lender. No paper in hand...lol.

From what I read, many guys get the idea from their wife that they must purchase a "Brand New Home". lol Many brokers and businesses in that area will be cutting in on that deal. Chalk that up to ghosts/you don't love me/ it's for the kids....whatever reason. It comes down to helping out the hood.

just stating that thai law has little protection for us, as we are not citizens....

not the same everywhere in the world...much different in many countries, where you can represent your interests better, and with less corruption.

yes..i know...there are always a few happy guys out there that disagree...but notice they are few.

1. why dont fellas buy at a great discount these abandoned homes instead of building from square 1?

2. is the market so bad that even thai real estate investor decline these properties. or are the owners so stubborn they rather have NOTHING than something.

This one.

I allowed my misses to buy a brand new home simply because it was cheaper than a second hand home.

The developer charged the same price to everyone, the second hand market was x2 for foreigner involved.

The Thais preferred not to sell, than to sell to a foreigner wife for less than x2 the second hand price.

Also much easier to get a home loan on a new house, the developers have friends in banks.

I guess you haven't been here long. Yes, that's exactly how it works, sellers are not at all economically rational here, even major commercial property will sit empty for decades rather than the owner dropping their price below what they think it "should" be worth

My theory is that most property owners here have so much silly money the profit motive becomes secondary to "face".

Keeping in mind also that a lot of it is laundering too, investigate the history of some of the largest banks in the region (including ties to Singapore Hong Kong) and you'll find lots of them come from drug money, going back to the British and opium, then CIA and heroin during Vietnam. . .

I did not say walk away if I lost in a divorce you would get a fair 50/50 split I was saying that if you take the gamble of buying property and the future government changed the laws or tried to take the land away from your Thai wife because she has a farang husband and you lost in the courts then I would walk away. I don't have to worry about the first part we have been happily married for 14 years.

When it comes to a usufruct done when married then yes it can be broken by the wife in a Divorce case but you will get a 50/50 split in all your joint assets including the house & land. But I never had a usufruct for this reason it was only to protect me from my wife's family if anything happened to my wife. Buying property in Thailand is a Gamble and you must be prepared to walk away if you lose.

Why do you have to just simply walkway. Divorce and claim what is rightfully yours under the law.
