Civil court agrees to lift emergency decree

BANGKOK: -- The Civil Court late this afternoon agreed to lift the state of emergency declared by the caretaker Prime Minister Yingluck Shinawatra on January 22.

The call for the lifting of the emergency decree was made by a PDRC core member Thavorn Senniem against caretaker in a petition to the Civil court.

Thavorn said the declaration of the state of emergency by Prime Minister Yingluck Shinawatra, the Centre for Maintaining Peace and Order director Chalerm Yubamrung and Pol Gen Adul Saengsingkaew, deputy director of CMPO, was unnecessary and invoked unlawfully.

If the decree is lifted due to being unlawful, all those arrested under it will therefore have to be released. Oooops.

Could it mean that what they are doing right now is illegal ?

It could well be as they are claiming to be working under the SOE. Possibly it will be illegal from the moment the court lifted the SOE.

Will also mean that the media are no longer working under threat.

I don't think the crackdown being launched the same day the verdict was scheduled is a coincidence. The government wants the SoE to stay.

Least we forget the SoE was first declared following the grenade attacks against the anti-government protestors, the justification being that the protest had turned violent. Yes, there's something very wrong about that scenario.

then all CMPO done, were considered unlawful from Jan 22 to today. then the arrest warrant will be VOID, those been arrested today need to be free immediately ?

Amazing Thailand. You have gun battles in the streets, with grenades and other explosions, people on both sides being injured and killed, and there is "no emergency" as stated by the courts? What country are the Judges living in?

These people are dirty, violent, attempting to overthrow an elected government and insert themselves back in power.

if there was ever proof that an emergency existed you only needed to follow the actions of Suthep and the sedition movement on the streets of Bangkok today. The city and it's people are less safe without the SEO in place and the looneys are empowered.

I agree 100%, if Bangkok is not in a state of emergency, no place in the world would ever be.

Armed protesters killing cops the same morning as the courts lifts the decree, poor judging and even more poor civil court.

It is well acknowledged that the emergency decree was not needed and for the UDD to compare it to the emergency decree in 2010 is like comparing apples and oranges.

The sad thing is the senseless deaths of the poor policemen and the injuries are now solely on the hands of chalerm and yingluck. Had the emergency decree not been implemented none of this senseless lose of life would have happened.

I look forward to chalerm and yingluck on murder charges alongside Abhisit and Suthep.

This is an enormous victory and a decisive slap in the face to Chalerm. It also happens to be the right and just decision. Chalerm's emergency decree was a sham from start to finish. If anything, the nightly grenade attacks against the protesters became even more brazen and frequent. The police became even more invisible and incapable - though more likely unwilling - of changing any of that. Chalerm's big gambit to stifle the media has now completely capitulated, and has undoubtedly erupted in the spontaneous applause and wild hoots from every television anchor and TV news staff in the country. It means the detentions are gone. It means all arrests made under the name of the emergency decree are gone. It means all charges made against the leaders through the emergency decree are gone. In the words of the court the emergency decree was unlawfully imposed. It means that this administration will finally be charged through the Constitution Court of unlawfully issuing an emergency decree under a caretaker capacity, and within ten days of a national election - a circumstance without historical precedent in the world's free societies, and something that not even Robert Mugabe would have had the gumption to dare.
