Have Work Visa But Not Work Permit

Featured Replies

The company organized the non-immigrant visa and a work permit.

The employee left the company, and the company took the work permit back (the little passport sized book)

So, is the employee permitted to remain in the country until the visa expires? Look for work etc?

Another point,

what about this reporting to the authorities where you are/live every so often... do they really expect that to happen? Is it important? What happens if such reporting is not done? Where are acceptable places to report?

Thank you for reading!

If you are here on a 90 day visa entry you can stay until it expires. If you are here on an extension of stay you must report your loss of employment and leave.

Yes 90 day reports are required if you are on an extension of stay and yes they do expect you to do them. They can be done at any immigration officer or by mail. Normally there is a 2,000 baht fine for being more than 7 days late.

For somebody with a type B non-immigrant visa, that still had an extension of stay for four more months... it would mean they would have to leave the country? What if they found another job suddenly? Does it mean the moment the employer takes posession of that work permit and ends the contract, the employee is then immediately obliged to start heading towards the border? I find it difficult to believe, but you must know what you are talking about...

Is there a special form needed for filling in to do the reporting to the immigration office?

You must inform immigration and then are allowed about a week to pack out. Not sure if you have to fill out any formal form but I suspect immigration probably takes care of that part.

It is no different than if you are in the country to support a Thai wife extension of stay - no wife, no more extension of stay and you must leave.

When I quit my job about 3 years ago, I surrendered my WP to the Labor Ministry personally. Then, I went to Immigration to see what I needed to do. No one there seemed to know what I wanted. At the time, however, I had applied for a renewal of the one-year extension. I had one of those stamps that says the application is under consideration. Anyway, nobody did anything.

During the two years that I worked for that employer, I never did a 90-day address report, either.

Some people slide, some go to jail, some get deported and black listed. The odds may be in your favor playing Russian roulette; but it is not a game I would care to participate in.
