A friend of mine is in a similar position as me where he has been trying to get a residency in the UK for his girlfriend. It hasn't gone to plan and she has now returned Thailand and he is hoping to follow soon.

They have made plans to live there but she has since discovered that she is pregnant.

Although this wasn't planned does anyone know if this will be in their favor as far as him trying to get a visa for her.

She is still married to a cruel husband which she is trying divorce and has been in the relationship with my mate for about a year.

Any advice appreciated.

Unlike the rules in Thailand most European countries more or less automatically grant a parent to a national residency. Check with your foreign ministry the rules for UK.

While I am both the registered father and provider for our kid Thai immigration don't even take that into consideration, all they care about is the marriage certificate. :o

Thanks for the quick reply. To be honest they do want to go to Thailand, but it would be nice for his girlfriend to have some freedom should they wish to return.

I'm afraid the UK does not automatically grant citizenship to children born abroad, of males who are not married. You have to apply to the Ministry and wait up to 18 months. So no benefit for visa purposes.

If your asking about the visa for the girlfried to the UK then best post in the Visa section of this forum but fyi, if they intend to live in Thailand then she will not get any kind of residency or spouse visa for the UK & any visits to the UK will mean she has to go to the embassy in BKK & aaply for tourist visa. But if they get married the child, providing the father is named on the birth cert. will get automatic british citizenship & be entitled to a British passport.

Partner expecting baby in october and still will not be married to her by then. Are you saying that as long as i am listed on the birth cert as being the father once we are married it will be a simple case to get british citizenship & passport for the child?

I did try reading the embassy webpage but it read (to me) that the child would have no rights out of wed lock.

Should you be unmarried when your child is born, s/he will not automatically be a British citizen. However, should you and the child's mother subsequently marry, this generally makes the birth legitimate and the child would then, depending upon how you obtained British citizenship, qualify. You have to be British other than by descent. Usually, this means that you were born in the UK. Your child born in Thailand would be British by descent and would not be able to transmit his/her British nationality unless any of their own offspring were to be born in the UK.

Yes you can apply for the child's citizenship and a passport when you are married, and it will be fast tracked.Rather than unmarried, when you have to make a special application.
