webfact Posted May 18, 2014 Share Posted May 18, 2014 Senator threatens to sue acting premierThe NationBANGKOK: -- Senator Paiboon Nititawan yesterday threatened to take legal action against acting Prime Minister Niwattumrong Boonsongpaisan if he insisted on scheduling the election date with the Election Commission (EC), as he did not have the authority.Paiboon cited a Constitutional Court ruling earlier, barring charter court chairman Charoon Intachan from joining a selection committee to nominate Election Commission members because he had not yet been royally endorsed.The senator also said that Article 5 on a Royal Decree to schedule an election date clearly authorised the prime minister and the EC chairman with the responsibility, which Niwattumrong could not discharge because he did not have the authority, as he is not the PM.EC member Somchai Srisuthiyakorn said at the next meeting with the government, the EC wanted to resolve two issues: whether the acting PM has the right to countersign the Royal Decree on scheduling the election date, and whether the EC has the authority to inform the PM to postpone the election in certain eventualities. The agency also wants to know if security agencies are ready to provide safety to voters to ensure that the next election will not become another wasteful exercise.He said it would be impossible to schedule the election on July 20 because there was not enough time to seek a Royal Decree on scheduling the election date. One would expect this senator who is trained as a lawyer and was a "consultant" to the Constitution court to understand that basic procedure. However, as this man has been at the forefront of the attempt to bring down the elected government since the protests started, it shouldnot come as a surprise. Civil War Posted May 19, 2014 Share Posted May 19, 2014 the EC wanted to resolve two issues: whether the acting PM has the right to countersign the Royal Decree on scheduling the election date, and whether the EC has the authority to inform the PM to postpone the election in certain eventualities. This is more than reasonable in light of the PTP / CAPO / UDD constant threats of arrest and prison towards the commissioners if anything goes wrong. Just like Feb 2 when the EC almost begged the government for 2 months solid leading to the election date that it was a mistake to go ahead on Feb 2nd... they were constantly ignored and threatened... The EC predicted correctly and the response from the government was that they blamed the EC and threatened them with lawsuits to sue for the lost money and also dereliction of duty and jail time. The EC have the right to insist on legalities and to cover their backs if the government tries to force them to repeat the same mistakes as the last time.... which the government are surely already demanding with full UDD and CAPO backing and threats of prison. 2 Link to comment Share on other sites More sharing options...

Everyone believes that the elections should go forward and it should be fought over what reforms to enact and who should do it. The results would serve as a referendum and show the will of the majority. Also everyone thinks that the opposition is a joke and we are all amaze what a mess they have made of the country.... The process to end this can only happen if it could be ascertained that Caretaker MP Niwatthramung has the power to sign off and present for Royal endorsement as Acting, Caretaker PM to the EC to call for an election. but he doesn't seem to want to push too hard, given he would then be obligated to present Surachai as Deputy Senate Speaker for Royal Endorsement allowing the senate to open, with its first order of business to take a vote (60% majority needed) to ban YL, Niwatthramrung and several others pursuant to NACC indictments from politics for 5 years. Kind of a Catch 22. Hence, if you have followed this, nobody is sure Niwatthamrung even has the power to call for an election or open the senate. Instead, respecting each other, politics aside, they are trying to work their way out of this. It only begs trouble. And the narrative of Prompong and Pheu Thai has been so vicious to the EC ( threatening prison, no less ) that it hardly engenders trust. The dynamic seems to be Pheu Thai experimenting with just how far they can go and how just how far they can threaten. They clearly don't recognize any limits to the bullying. It's really rather incredible, and one has to pinch oneself as to how commonplace it has become for Pheu Thai to bully, threaten prison, threaten treason - the only buffer Pheu Thai has from the West is that they don't take a greater interest in this, because if they did, they'd be truly appalled. The EC has two very good points - the question of Niwattumrong's legitimacy, and the question of whether an election postponement is possible to be included in a decree, lest February 2 happens all over again.
