Hey there all you lovely Chiang Mai people!

Wonder if you can help with my query...I am seeking an experienced and professional Lawyer to conduct a land title search on some land in Mae Rim. Helpful suggestions and words of wisdom (of which there are many on this forum) will be much appreciated.

Sorry I do not know who to recommend but it is great that you are doing a title search, many folks don't bother and some pay a heavy price.

I will not recommend a Lawyer for you to use however I will make some suggestions for you on this topic from my experience.

Ten years ago I found a residence for sale in a popular moo baan. Manager of the moo baan put me in touch with the seller. We arrived at an equitable purchase price.

As a former Real Estate Broker in America I knew the routine...................in Florida. 1st big mistake !

I employed a local lawyer to do a title search. He assured me the Chanote was clear of liens other than the existing mortgage held by a local bank....2nd big mistake.

On his word a substantial earnest money payment with closing within 6 months. 3rd big mistake.

Time was required for my Thai wife to close the sale on her home.

On the day of closing we met at the lawyers office and completed the necessary paperwork, then retiring to the appropriate Ampur to transfer the Chanote to my wife's name.

FULL STOP.................Ampur will make no changes to the Chanote......There is a CLOUD on the title.

It took me two years and a lot of money to clear the title and accomplish the transfer. The lawyer assigned two subordinates who did not work for free.

Suggest you acquire a copy of the existing Chanote, both sides. If held by a bank go to the bank and get a copy. The seller should assist you.

Go to the appropriate land office with the copy of the Chanote and do a search. My understanding is a title search cannot be done without the information on the Chanote. It will require a Thai assistant if you do not speak Thai. By-the-way there is no such thing as title insurance here.

Or you can throw the dice and hope it doesn't come up 'snake eyes'.

With 6 months wait for closing you left a lot of time for things to happen to the title and to the property.

Did the title problem arise in that period of time or did it exist prior to the lawyer's title search?

A para legal can do this quite easily. It's not rocket science. Owner has a copy, and there is a duplicate at the Amphur, and that one will likely take precedence over the other one.

6 months was way too long. Minimize your EMD, and demand it back, when they can't close.

Florida is the real estate fraud capital of the free world. Any Russian will tell you that.
