Jatuporn and Nattawut given two-year suspended sentences

BANGKOK: -- Redshirt leaders Jatuporn Prompan and Nattwut Saikua were on Tuesday given two-year suspended jail terms after they were found guilty by the Criminal Court of illegal wire-tapping of phone conversation.

Both Jatuporn and Nattawut were prosecuted by the state attorney-general for exposing in the public the illegal wiretapping of phone conservation between former PM’s Office Minister Pol Maj Gen Peeraphan Premphuti and Mr Viraj Chinvinichkul, former secretary of the Supreme Court and Mr Phairoj Vananuj, an Appeals Court judge on June 22, 2007.

The conversation was exposed at a protest rally in Sanam Luang.

Considering that the wiretapping and exposure of phone conversation was a crime and violation of the privacy of others, the Criminal Court sentenced both to three years in prison, and a 60,000 baht fine.

However the court commuted the sentence by one-third to two years in jail and a 40,000 baht fine after confession of boh defendants was useful for the trial.

But the court reasoned that since the two were never sentenced to serve prison terms in the past, and a plaintiff in the case did not wish to pursue the court case against them, the judge agreed to give them a two-year suspended sentence instead.

Both Jatuporn and Nattawut refused to give any comments to the media representatives as they emerged out of the court room after the sentence.

But their lawyer said currently all redshirt leaders have ceased their political activities but doing physical exercises every week together at a sports stadium.

All they need now is an additional 2 years suspended sentence for terrorism. Then they have the full hand.... Thanks Supreme court.... once again, and can we thank the criminal court for arranging for us to be the only two people on terrorist charges from the 2010 attacks to be walking free and breathing the fresh air.

Terrible decision that flaunts the lack of bite in the poorly crafted anti-wiretap laws of Thailand. Wiretapping is technically illegal in Thailand, but there are no criminal penalties for illegally conducting a wiretap. There are only criminal penalties if you publicly disclose the illegally wiretapped conversations.

Here, that is exactly what Jatuporn and Nattwut did. Yet, the court, in its infinite wisdom, suspended their punishments. The lesson anyone should get from this is that illegal wiretapping will go unpunished in Thailand.

Jatuporn, Nuttawut get suspended jail term for telephone eavesdropping

BANGKOK: -- The Criminal Court on Tuesday convicted former deputy commerce minister Nuttawut Saikuar and United Front of Democracy against Dictatorship chairman Jatuporn Promphan for eavesdropping on a telephone conversation of a former secretary of the Supreme Court.

Jatuporn and Nuttawut were initially sentenced to three years in jail and were slapped with a fine of Bt60,000 each. The court however commuted the sentence by one thirds to two-years imprisonment and a fine of Bt40,000 each.

The court eventually suspended the jail term on grounds that the person damaged by the eavesdropping sent a statement to the court, saying he understood why the two had listened in to the phone conversation.

Jatuporn, Nuttawut and former PM's Office minister Jakrapob Penkair played the tape of phone conversation between the then permanent secretary for PM's Office Piraphan Premputi, the then secretary of the Supreme Court, Wirat Chinwinijkul, and Pairoj Nawanut, then a Supreme Court judge at a UDD rally at Sanam Luang.

One could suggest the courts are biased and lean towards the red shirts. I don't say that of course because that would make me look silly and foolish. Attacking the courts when the make lenient decisions against violent criminals is not the fabric I am made of.

Of course reform is needed in the judicial system without question, but under the current framework one cannot question the ruling.

I won't throw sh*t at the judges, burn effigies of them, hand out their street addresses or throw blood at their front doors. You know what I will do? Accept the ruling and move on.

Well as Jatuporn has more chins than a Hong kong telephone directory I am not sure what 'exercise' he is doing. Would love to see a vid of that.

As for the sentencing - incredibly disappointing. A 2 yr suspended sentence on top of another 2 year suspended sentence. Seems Judicial sentencing also needs to be part of the current review process. One Nation, One People, One Law!

Thats funny. Didn't Jatuporn get a 2 year prison sentence(suspended) in May for defaming Khun Abhisit? Rhetorical question, yes he did.

As we all know, members of the establishment(even though some of them frantically deny being part of this elite) do not get punished. This would have been a perfect chance for the junta to prove neutrality and give Jatuporn a fair and long sentence, instead we continue to live in anarchy with red criminals getting away with crimes ranging from this one, to the hacking off of an old man's arm with a machete and then shooting him dead. Again, no need to serve your prison sentence.

Blame the new governent sir, the reds are not in power, u nless you forgot

Its the same with the so called dialogue with Thaksin , you don't want to be antagonizing the majority of people who have had "Their" government removed in a Military coup. Its been remarkably peaceful from what could of happened , best not to start wielding the cosh now

Golden - these 2 boys continue their charmed lives. No real punishment for them. Bit of a telling off, slap on the wrist.

Perhaps Jatuporn's amulets protect him after all and he looks after his buddy.

If I were a red shirt and had friends and relatives locked up since 2010 I'd maybe start wondering about what deals these boys have been up to, along with Arisman and his missus.

How many suspended sentences can you have at one time?

Old fat head has had more suspended sentences than he deserves yet continues to ride the 'get out of jail free' card, lucky flucker!

Yet the rest of us are regularly punished just by seeing his picture.

When will some judge please bang this thug up?
