neighbors building plans

Is there any way that I can view my neighbors building plans. He is building next to my fence and it looks like he may be building 3 stories. I dont want nosy people looking down into my back yard and into my house.

If it's in a town then he would need a building permit with an authorized plan. That should be from the land office!

Land Offices do not issue or approve building plans, that is the province of the Tessaban, who have engineers that work there to review them

You do have a right to view the plans since he is building near you , but there is not much or anything that you can do if he is legally building a 3 story house

Your right to privacy is not guaranteed in Thailand

In Pattaya for example immediate neighbours have to sign that they agree with the building proposed (by law). Don't know if that is common practice all over Thailand. It certainly wouldn't be the case in the villages with no chanotes on land etc.

You might have a building height restriction for your specific area, check it out at your Tessabaan. We have such in some areas in Phuket but would not care to bet on the enforcement of such. But if there is such a limit much easier to stop the build early on.

The wife talked to city hall (or whatever the office is) and they said that the plans are for 2 stories. the other good news is that he was building too close to us to have windows needs to be 1.5m away. He threatened the wife to see her in court after she explained the situation. It looks like he has relented and his second story is 1.5m away.

The wife talked to city hall (or whatever the office is) and they said that the plans are for 2 stories. the other good news is that he was building too close to us to have windows needs to be 1.5m away. He threatened the wife to see her in court after she explained the situation. It looks like he has relented and his second story is 1.5m away.

Your wife should never have had any contact to "explain" anything with the person that was building. The tessaban should have been the one to inform him of the rule

The three story fear may have been a False alarm but you now have a neighbor that will be looking for payback

Very true, the Tessa Bahn or local Orbitor should have never issued a building permit if the plans fell outside the official requirements. Checking the Location and Layout sheet of the Drawing Set (usually sheet 3) would have revealed any shortfall.in compliance, very quickly. Unfortunately desires can be realised by unscrupulous means, so these things are always worthy of a double check by interested parties who may be affected.

Sadly, I feel that the second statement could be true also.

He contacted her after the land office contacted him after the wife contacted the land office. Seems that what he was doing was not legit but if he got the wifes permission then he could go ahead. She did not give the permission as it would negatively affect our home. If he wants payback for that, well its a 2 way street.

So his window facing you is a whopping extra 50cm away from your boundary; will this massively change the overlooking situation?

I doubt it.

Now you just have just made a grumpy neighbour and an unpleasant tension in the air. Probably cost him money and messed up his plans/ reduced his room sizes by half a meter on that side; for nothing really.

You should have left your Western nanny state mentality back where you came from.

If you didn't want to see his new structure , on HIS land, then you should have planted trees on YOUR land.

Why should the OP and his wife accommodate their neighbour when the neighbour is breaking the law and impinging on their privacy, which would also damage the value of their property. Why should he plant trees on HIS land, when the neighbour is in the wrong.

Sometimes having a neighbour who you are not on talking terms with is a godsend.

Congrats to the OP on having a wife who stands up for her rights. Due to face and misplaced worries about repercussions, many Thais would have gone the mccw way of doing things. Anything to avoid conflict, disregarding that their own rights are being trampled upon.

The second aspect is worse than pissing off the nieghbours.

I do agree that 50cm is neither here nor there. It's the principle though. I like to believe that I would have done the same as his wife. My wife would probably have told me to forget about it though.
