Renting out house to foreigner .... when, who, and how to submit TM30

Hi, my thai wife and I are out of thailand at the moment but have our phuket house rented to a foreigner with a thai work permit.... I'm wondering how we are supposed to submit the TM30 for our tenant. I heard that it can be a 2000 baht fine per day to the homeowner? True or not? Thanks for any info on what we are required to do and how to do it from outside of thailand.

Hi,

is your tenant renting your house through his company, or is it a private contract between you both? I guess if it is just an arrangement between you and the lodger, you don't need to do anything, except maybe if you declare the rent and pay taxes on it. From what I understand, TM30 is for hotels or guesthouses with a licence, or appartement rented by a proper licensed company. Declaring it would mean that you have a working permit to make business and receive income in Thailand. Anyway I've never heard of the immigration checking out the owners of condos or houses lent to foreigners. I think that as long as you haven't declare your status as a real estate company with the proper documentation, the immigation or whatever administration in charge won't be able or care to spot you.

Yann, thanks for your input... the tenant is paying directly to us from him.... no companies involved. I think he has a work permit but not exactly sure which type.

We have another small townhouse that we rent directly to a Scottish guy with a retirement visa.... they wouldn't give him his visa unless we filled out the tm30 ( in Phuket Town ) . We filled out a tm30 pdf with all of the foreigner info as well as our info ( private thai homeowner ) . He printed it and brought it with him to get his visa sorted. So we figured we better check to make sure we were good legally on our second townhouse.
