Yingluck's lawyer seeks justice from NLA

BANGKOK: -- The legal advisory team of the Pheu Thai party today urged both the National Legislative Assembly (NLA) to fairly treat the former premier in the proposed impeachment case pushed forward by the National Anti-Corruption Commission (NACC).

It also seeks the intervention of the National Reform Council (NRC) to double check the performance of the NACC as its rush to push for the impeachment against Ms Yingluck Shinawatra by the NLA remained sceptical.

The head of the team, Mr Pichit Chuenbarn, also the chief lawyer of Ms Yingluck, noted the rush to impeach her despite earlier decision by the attorney-general to hold the indictment of the former premier in court citing incomplete evidence to charge her in connection with the rice-pledging scheme.

In August, the NACC sent a 4,000-page investigative report in four boxes on Yingluck’s allegation of dereliction of duty in the rice scheme to the Office of the Attorney General. In this case, she was accused of negligence of duty and tolerating the scheme, continuing its corruption and causing losses to the state of about 500 billion baht.

But Mr Pichit said Friday that the move of the NACC was a rush citing the merger of two cases, dereliction of duty in the rice scheme, and the impeachment, into a single case which was a cause for the attorney-general to reject prosecution against her.

Later, the NACC pushed forward by splitting the two cases and proceeded impeachment to the NLA which was unfair.

He went on saying that on October 8, the NACC resolved to impeach Yingluck on charge of causing huge loss to the country over the rice scheme, using the anti corruption organic law as a tool without mentioning Article 178 of the 2007 Constitution which was scrapped after the military coup in May.

He then urged the NLA to ensure justice for the former premier under Order No 63/2557 of the military junta
on issue relevant to the NLA’s power to execute the scrapped charter to impeach her.

The legal teal also called on the NRC to look into the case to ensure that the NACC will not discriminate any particular case but treat all cases in the same standards.

He added it still was not yet known if the team would petition the Constitutional Court to interpret the power issue of the NLA.

Fairness for the despot who all but destroyed the Thai rice regime. Was there true justice in Thailand she would already be behind bars, or on the run just like dear old brother who also milked this country from a position of trust.

Isn't this request a little late? It appears that ship sailed a long while back.
