Between marriage and divorce

Hi,

I have a multi-entry non 'o' imm visa based on marriage and I am approaching the possibility of the divorce.

I have a full responsibility to up-bring my biological daughter (Thai, age of 8). My wife & myself agree to follow the mutual understanding.

If we go to aumphor for request the divorce process and request for 100% sole child custody,

the realistic question: will the divorce not be granted until the 100% sole child custody certificate must be issued from court first OR can the divorce be granted before the court approval?

I am not sure how the local immigration will proceed my extension next March 2015.

Appreciate the constructive response if possible.
