13/11/14…new member here,….wondering rules on changing to Retirement from marriage Visa.

Pending a separation and possible divorce, I need to be prepared to stay in country legally when residence changes. Any help would be appreciated. I have been here 2 years on Marriage Visa.

Is that a one year extension from local immigration, if so when is the year up. if before divorce , you can change then with no problem, to one year extension reason retirement

Some immigration offices will want your wife present so she is notified of this change your making.

Yes, my annual extension is in May and I would like to go in before then to change to Retirement….and yes,…with her knowledge. I have the income/savings to qualify but wonder about things like a current records check…since I have been here continually for two years and the records check I brought from the US was dated just prior to moving here in dec. 2012. I do not want to go back just to get a statement that I am not a criminal! 555.

You will not be able to change the reason for your extension before it expires or you get divorced.

A criminal records check is not needed to get an extension. That is only needed to get a OA visa at an embassy.

Then, if I move from the current marriage address prior to extension ( due to separation ), I will be in violation and unable to file 90 day form…..Hmmmm…wonder if it would be acceptable to change visa type at that point?

Just being separated will not end your extension or make it invalid. You could still make your 90 day report.

You don't have a visa to change.

Thank you….was concerned that if I recorded new address ( without wife sharing new address ), I would be in violation. Appreciate the input!
