My NIB was "activated" on Sept. 7, it says "valid until Dec. 5"

My WP says "Valid until March 1, 2015"

I keep hearing that I have to go get a new NIB, but I called immigration and they said I can just come extend there (but of course there is a good chance they have 0 idea what I was talking about).

With paper work from your employer and the work permit you can get a one year extension.

I assume the work permit is from your current employer.

A visa entry is not tied to an employer only an extension of stay is.

No. The WP is still under my former employers name. I just left my former employer and signed my new contract last Thursday.

I don't think I ever got an extension to match my NIB with my WP like you're supposed to.

But international relations lady at my new employer said something about not being able to extend because Dec. 5 is less than 24 days away or something??? She said if it was more than 24 days I could extend at immi, but since it's less I have to leave the country.

24 days may be incorrect, I don't remember the exact number of days she stated.

There is no minimum amount of time to apply for an extension. It can be done on the last day even.

But you are going to need at least letter of approval for a work permit application done by the new employer to do the extension.

Your existing work permit needs to be canceled and you will need a letter from your former employer stating you are no longer working for them.

Alright cool. So I'll ask for the paperwork from the new employer (which she said she be ready in a few days) and I'll get a letter from my old employer. Then I can go to immigration and get an extension? Then I can go get my WP switched?

What if my old employer refuses? I left on 'good' terms, but you now.. this is Thailand.

You will have to at least have the new work permit applied for in order to get the extension.

The is no switching of work permits. The old work permit needs to cancelled before the new one can be issued.

What you're being told here is the same as immigration told you:

You do not need a new non-imm. "B" visa in order to apply for an extensions.

Yea I understand that. But I'm just musing that maybe the new employer told me to get a new NIB because it is less paperwork and a simpler process. Go get a new NIB and then fix the WP as opposed to fixing the WP and preparing documents from new and old employer and then going to extend current NIB.

The paperwork to get a new work permit is exactly the same whatever visa you have, but as ubonjoe said they may think a work permit application is tied to the visa, which is not. There is no "fixing", you apply for a new permit on the same day the current one is cancelled.

You will find that if you can at least apply for the new work permit before Dec 5th, then that requirement is met but you may still not have enough to obtain an extension. If that is the case what you can do is to travel to Penang to obtain a multi-entry non-imm 'B' visa, valid for one year.

1. Application form
2. Copy of applicant’s passport
3. Certificate of alien’s employment in the format prescribed by the Immigration Bureau
4. Copy of work permit (in the case of change of workplace, an acknowledgment of application may be used)
5. Copy of evidence proving company registration, such as a certificate of company or partnership registration, certified by the registrar within the previous six months
6. Copy of list of shareholders certified by the registrar within the previous six months
7. Copy of balance sheet and profit and loss statement for the latest year, together with income tax return for companies or juristic partnerships and payment receipt
8. Copy of latest monthly withholding income tax return specifying the names of employees and of the alien applicant together with a copy of payment receipt
9. Copy of the individual income tax return for the latest year and payment receipt (if any)
10. Copy of social security contribution return for the latest month, as filed with the Social Security Office (Form Sor Por Sor.1-10) and payment receipt
11. Document or evidence proving the necessity of the business to hire the alien, for example, in case a job opening was posted for Thai candidates but there were no applicants
12. Location map showing the applicant’s workplace and photographs of interior and exterior of the workplace during business hours
13. Documents or other evidence requested by the Committee monitoring official proceedings of officers of the Immigration Bureau
14. For an international trade business (representative office), regional office, and overseas company (branch office), documents specified in Criteria 6, 7, and 11 are not required

fffuuuuuuu this is all so confusing. I've talked to immigration, new job, and asked on a few different forums and I've gotten different answers from everyone.

I'll contact my new employer tomorrow and share all this info with her. Hopefully they'll cooperate in getting me all the necessary paperwork and stuff to get an extension on my current visa. I realllllly don't want to leave the country and get a new one.

Remember that what you need first is the new work permit or at least application receipt. If you can't convince them that this is the correct sequence, (for example having them check with the labor office), then you're stuffed and you will have to leave country for sure, even to the point of getting a "tourist visa for time being", that's something that employers often do.

Considering the little time left on your allowed stay I think that is the most expeditious process.

Note however that unless you work as a teacher the consulate will require a letter of approval for work permit. Point 4 under non-immigrant B documents list

2. Recommendation letter from the institution addressed to the Embassy (stating about the employment and visa application) and be accompanied with the certified copy of the ID of the endorser

3. Employment contract

4. Form of the Employment Certification

5. Copy of registration certificate of the concerned academic institute

6. Copy of applicant’s academic certificate/record

7. Copy of the recent police clearance or certificate of no criminal conviction.

8. Copy of the previous/current work permit (if any)

But also the requirements for an extension of stay are much simplified, meaning that doing things correctly you do not need to leave country:

2.7.1 In the case of a teacher, professor, or expert in the following educational institutions:
(1) General education such as general education, English program schools, vocational schools that follow the Ministry of Education’s curriculum, and international schools:
1. Application form
2. Copy of applicant’s passport
3. Copy of work permit or application form in case of changing institution of teaching during the validity of work permit.
4. Copy of evidence of permission to establish said educational institution issued by the relevant government agency
5. Letter of confirmation and request for a temporary stay issued by the educational institution, specifying the applicant’s title, monthly salary rate, and term of employment, together with a copy of a letter of teacher appointment in the format required by the Private Education Commission
6. Copy of a letter of teacher appointment in the format required by the Private EducationCommission
7. Copy of a teaching license or a certificate of license issued by the Teacher’s Council of Thailand or a copy of a letter of waiver issued by the Teacher’s Council of Thailand or a copy of an acknowledgment of waiver request issued by the Teacher’s Council of Thailand (except for teachers, instructors, or experts of higher education)

Okay. 1 & 2 I have.

3 I am waiting for.

4, 5, 6 I assume will be given to me by the school?

What about 7? I have not taken the cert exam... it never came up when applying previously?

. I think you will need the waiver, you can ask in "teaching in Thailand" forum on how to obtain it.
