Prayut indicates Thaksin could face lese majeste charge

BANGKOK: -- Prime Minister Gen Prayut Chan-o-cha indicated today that the former prime minster Thaksin Shinawatra could face lese majeste charge if he is found to have committed the offence.

The prime minster was commenting on the revocation of two passports held by Thaksin by the Foreign Ministry following recommendation by the Royal Thai Police regarding his press interview with a South Korean media in Seoul last week.

The Royal Thai Police said in its recommendation to revoke his passports was based on the interview which it deemed a threat to national security and damaged the country’s reputation and dignity.

The Royal Thai Police said police are looking into details in his interview to file charge under Article 112, 326 and 328 of the Criminal Code, and the Computer 2007 Article 14 (3), (5).

Article 112 states that “Whoever defames, insults or threatens the King, Queen, the Heir-apparent or the Regent, shall be punished (with) imprisonment of 3-15 years.

The Defence Ministry, on order of Army chief Gen Udomdej Sitabutr, also deputy defence minister, has designated the Judge Advocate General’s Department to file lese majeste against Thaksin.

Gen Prayut said Thursday the passport revocation and the charge under Article 112 was a procedure which authorities concerned are working on it after a complaint was filed.

The complaint claims (the interview) accused others in an excessive manner, he said.

He also said whether the former prime minister might have his police rank stripped or not depended on evidence and law, and when time dues.

Meanwhile Royal Thai Police commissioner Pol Gen Somyot Phumphanmuang said investigators proposed to revoke Thaksin’s passports after they went through the interview and deemed it violated the said laws.

He said the revocation has nothing to do with politics or he has any bias.

Sorry Mr P, but most foreigners here have seen the interview, and nowhere in the interview does Mr T cross the line.

He implicates the elite in being behind the coup to maintain status quo, and not even the most yellow shirted supporter of the present situation can deny that!!

By all means, go for Mr T, he should be behind bars, but play it clean!!

Using the Thailands draconian LM laws doesn't make you any friends, here or abroad!!

Probably clutching at straws but as its a law which doesn't allow suspects or convicts to be bailed i frankly think its use here is justifiable considering just how dirty thaksin's hands are.

If they get the charges to stick he'll never come back. Sure hope they do stick now...

. this law is viewed by much of the west as infringing /challenging individuals freedom of speech and charging him with this will/ could just strengthen thaksins hand in gaining international 'sympathy.'

ie down trodden democratic leader in exile ect ect more good pr for him to build upon.

LM is the political gag of choice. Problem is, it doesn't work so well if the offending person is outside the country. Baffling as it is for the elites their huffing and puffing sorta ends up getting the offender more airtime, more newspaper coverage, generally more exposure.

Dammm that pesky internet, why cant we return to a simpler age when what we said was gospel truth!

Are you living in fantasy land? How do you come out to say that ALL corruption has been exposed? Very little has been learned so far compared to the depths with which this country uses corruption.

There is not, cannot be, will never come, any chance to start, let stand achieve, 'reconciliation' negotiations in this country as long as the Shins' tribe will be around, not just in politics, simply in Thailand: they just want to own it as their fiefdom for their own profit, that and only that, more prone to destroy it totally when they can't get what they want!

Thaksin has four LM charges against him already. So what if the General adds a fifth?

Didnt know that, in that case makes no diference baring it gives him fresh international press coverage, which i'm sure Ostend his pr bod will relish.

It just goes on the list of those that he's unlikely to answer anytime soon as he won't be giving himself up voluntarily, extradition is not on unless the junta really want such a figurehead here and even if they try to bring him back many countries probably won't be interested in LM charges.

The PM is exercising his ' I'm in charge routine ' and little else.

Didn't think the privy council was covered under 112, but these guys make it up as they go, so no surprise.

They can't get him to court on the charges he is already facing so how are they going to get him to answer these charges. All hot air on the part of the Thais

When is Prayuth going to drop his obsession with routing the PTP and get on with tackling the many many problems facing this country? All this is really showing up the real reason for this power seizure. If anyone were still in any doubt.

When are you going to wake up to the fact that PTP are a pack of criminals taking payment from another criminal to vote to his orders, and that is the major problem facing this country? You get rid of the leeches before you start the transfusion.

The many problems in this country were created by the PTP TRT or whatever they want to be called... it's all the same. As Thaskin is a cold face liar he cannot seem to keep all his lies (like most liars) in order. Dealing with these self serving scoundrels

is and should be the first order of business. I would hardly consider it obsessive. Thaskin took a poke and the General poked back...The obsession I see is the shin a whats? mongering for power and control.

No it was the middle class and they did it to change the status quo.

In one speech he spoke about some other support than the elites and this is illegal in Thailand.

Thailand certainly has some "unique" laws. The judicial system and laws really need sorting out.

Ironic though that a man who used to sue for defamation and use laws to intimidate any who spoke out against him or his government is now on the receiving end of some.

Wonder if the cartoonist who Yingluck sued and set Tarit on is laughing? Perhaps time for some new cartoons whistling.gif

You are missing the point!!

The institution don't need any special law to protect them, they are respected and loved by the people.

The LM is merely a political tool, used by politicians to serve their personal and political agenda.
