Hello,

Due to a change in family circumstances I'm looking into staying in England with the hubby for another year or so, so am looking at the spouse visa.

I meet the financial requirement in my current job, but have been getting other job offers, they also meet the requirement but would mean not being in the same job for 6 months. I started my current job in February. Previous to that I was self employed. If we are going down this route we'd be applying in December, so whilst I will have been working and meeting requirements it won't be with the same employer. Would this be an issue or as long as I have everything from both employers, payslips etc would it be ok?

Are you currently living and working in the UK?

If so, then, from what you say, you will meet the financial requirement if you change jobs and still have a salary at or above £18,600 p.a.;

See 5.3. Category B: Less than 6 months with current employer or variable income – person residing in the UK

If you are currently living and working in Thailand and when the time comes for your husband to apply you have a confirmed job offer in the UK with a salary at or above £18,600 p.a. starting within three months of your arrival, then you will meet the requirement if in the 12 months prior to the application you have had a gross income in Thailand of £18,600 or more.

A bit of further help required.

So whilst I am in the UK, my current job and prospective new jobs are over the threshold. So I pass part 1 of what was stated by 7by7.

However if I change jobs and I want to as its a payrise, I need to prove my income for 12 months prior to the date of the application. I was self employed, how would I do this ? Would I need to do all the paperwork for self employed people as well?

I started my skates job on February 9 th we intend to apply in December so I have 6 weeks of income to prove, I added up my current and future salary and sadly they fall short of the minimum level i need for 12 months, also thought that could be a way around it.

Any suggestions... And yes we could wait another 2 months if we have to but my mother is gravely ill and I'm pg so speed is if the essence!

I'm sorry, but I'm getting confused. So before I attempt an answer, please clarify some points for me.

1) Where are you working now; Thailand or the UK?

2) From what you say, I think the job you are considering is employed; but is your current job employed or self employed and is that the only job you have had in the last 12 months?

3) Where is your husband now; Thailand or the UK?

4) If he is in Thailand then obviously the application he will be making is for the initial settlement visa; but if he is in the UK is the application for FLR or ILR?

5) If in the UK, when did he apply for his initial visa?

If before 9/7/12 he comes under the old rules and the financial requirement wont apply to him whether he is applying for FLR for some reason or for ILR.

If he comes under the new rules, i.e. applied for his initial visa on or after 9/7/12 then he will not be eligible for ILR until he has been living in the UK for at least 5 years.

5) If he is in the UK, does he work?

If he is legally working in the UK, which he will be if he is here with his initial visa or FLR, and is applying under the new rules then his income can be used instead of yours to meet the financial requirement. If he doesn't earn enough, you can combine your incomes.

1) I currently work in the UK

2) my current job which I started in February is employed, job I am considering is also employed. Previous to my current job I was self employed. I started my employed job on feb 9th 2015 we will be applying for visa in December.

3) he is in the UK on a visit visa but will be going back to Thailand

4)the application is for the initial settlement visa

So he's not working here or anything, justcstayingvwitn me until he has to return. I know you can't apply to settle whilst on holiday.

OK, not good news, I'm afraid.

From what I have been able to find out, if you change jobs then in the 12 months prior to your husband's application you will need to have actually earned at least £18,600.

If you don't change jobs then he can apply any time after 9th August when you will have been in your current job for 6 months.

So, unless you and your husband are prepared to wait until February next year before he applies, all I can suggest is that you wait until after his application has been approved before changing your job.

I've spoken to Tony M of Thai Visa Express about this, and he is of the same opinion.

I kind of thought as much. When I was self employed I was earning over the threshold, but as I finished in February it's not a full financial year. My tax return for the period covered is not due until next January so proving my income for those few months will be difficult.
