British baby visa question

Featured Replies

My Wife (British) and I recently had our first child in Thailand. I was curious if anyone could shed any light on the visa situation with respect to our child. My wife has a tourist visa and I currently have a work permit.

Thanks in advance for any advice

you mean you have a Non Immigrant B visa not a WP, and has the Visa been extended by local immigration?

Then your wife could piggy back yours, the child needs no visa in reality.

Your child can stay in the country without a problem until you take them out of the the country for the first time.

You will need to show their birth certificate to prove they were born here along with their passport.

If they return they would need a valid visa or extension to stay in the country.

Much depends on your intentions.

Do you have an extension of stay based on working?

Is your wife intending to remain in Thailand ?

Your wife may be able to obtain an extension of stay on medical grounds.

The baby will need a passport and you should expedite obtaining one for the child.

I have a full work permit and 12 month non Immigrant B and the child has a British passport. I'm guessing it would make sense for the child not to leave he country at this stage then? Would that present a problem further down the line?

You child can stay here for an indefinite amount of time without a problem because they were born here.

As said the baby presents no problem.

The babies mothers situation is not , however, secure if she is relying on a tourist visa to stay in Thailand.

Your own immigration status is important in relation to your wife's situation.

If you have an extension of stay based on working (ie. you make 90 day reports to immigration) it is possible for your wife to obtain an extension of stay based on being your dependent.
