Hi,

I thought you might help me.I'm quite confused.

My name is Natnicha Sengnguan,I'm thai citizen.

My husband is from Europe -Serbia.

I have a newborn son - american citizen with american Passport.

I have few questions:

Do we really have to apply for Thai Birth Certificate (for our newborn son) while still here in USA or we can do something once we get to Thailand ?

We want to go to Thailand and we need to go there soon since our visas expire very soon.

Once we apply,how long does it take to get Thai Birth Certificate in USA ?

We were married in St.Thomas (USA Virgin Islands) and do we need to do something with that

marriage certificate,like verify it with the state of department or something else so it would be valid in Thailand ?

Your help would be much appriciated

I've already answered your husbands question in the above link.

The answer is yes, as your child is born outside of thailand, he will have to get a "sutibat - koranee gert nai daang bratet" (sorry no Thai keyboard). This is totally different to the standard 'sutibat' or birth certificate which is issued in Thailand by the ampur.

At the same time as applying for the birth certificate through the consulate or embassy, you can also apply for a Thai passport for your son to enter Thailand on. Otherwise if he enters as an American, he will be considered a foreigner and subject to the restrictions of visa's etc. on your husband.

Remember, dual nationality has been allowed in Thailand for many years now, so none of the above will be a problem.

The final thing to remember is, that there are rules for your husband regarding visa's to stay in Thailand. He will need to apply at an embassy for a non-immgrant visa at a thai embassy or consulate before he departs, if he wishes to gain an extension of stay based on his marriage to you. And remember, to gain this extension of stay, he will need to show an income of at least 40,000 baht per month being earned by the family, otherwise he will need to leave the country every three months.

As samran advised, since your son was born in the USA, then you should apply for his Thai Birth Certificate in the USA.

You can call up the Embassy on Tel. 202-298-4810, 4812 to find out more information.

Following on, Thai passport applications have to be made in person as his photograph and footprint will be taken on-site. If time is short, it may be possible for him to use his US passport to enter Thailand and then apply for a Thai passport at one of the passport offices while in Thailand. However, he would be treated as a US citizen when entering Thailand.

You may need to authenticate your marriage certificate so that it can be used abroad. See also Authentication of Documents for Use Abroad. I think that you can also register your marriage at the Embassy.
